<br />~ <br /> <br />, <br />. <br /> <br />Extract of Minutes of Meeting <br />of City Council <br />City of Roseville <br />Ramsey County, Minnesota <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic Center Drive, <br />Roseville, Minnesota, on Monday, the 26nd day of April, 1999, at 6:30 p.m.. <br /> <br />The following members were present: Wiski, Maschka, Mastel, Goedeke, Wall <br />and the following were absent: None <br /> <br />Member Mastel introduced the following resolution and moved its adoption: <br /> <br />Resolution No. 9650 <br />A Resolution Amending Resolution 9644 Vacating a Portion of County Road 0 <br />In Connection with the Proposed Redevelopment at 3116 Fairview Avenue North <br />(Ric Cox: PF3092) <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request of Ric Cox <br />for vacation of a portion of County Road D in co~mection with the proposed redevelopment of <br />the parcel at the southeast corner of Fairview Avenue and County Road D (3116 Fairview <br />Avenue North) to allow for a small office building; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the Ric Cox request <br />for vacation of a portion of County Road D, approximately 7 ~ feet wide by 155.99 feet in <br />length, directly east of Fairview Avenue adja~ent to property located at 3116 Fairview Avenue <br />North, based on findings ofthe staff report dated March 10, 1999; and <br /> <br />. " <br /> <br />WHEREAS, the approved resolution describing the right-of-way vacation inadvertently <br />excluded a small portion ofthe right-of-way impacted by a roof over-hang that protrudes <br />angular (west to east).into said right-of-way; and <br /> <br />WHEREAS, it is in the public interest to correct the previously approved resolution <br />vacating a portion of County Road D in connection with the request for a Planned Unit <br />Development to redevelop the parcel at the southeast corner of Fairview and County Road D <br />as a small office building (4,000-5,000 s.f.); <br /> <br />NOW THEREFORE BE IT RESOLVED that the City Council of the City of Roseville, <br />Minnesota, hereby vacates a portion of County Road D, said area legally described as: <br /> <br />The South 7.5 feet ofthe north 33.0 feet of the following described property: <br /> <br />Commencing at the Northeast Quarter of Section 4, Township 29, Range23; thence <br />east 200.00 feet; thence south 133.00 feet; thence west 200.00 feet; thence 133.00 feet to <br />the point of beginning.
