(Ric Cox - PF3092) <br /> <br /> <br />1.0 Requested Action <br /> <br />1.1 City staff seeks approval of an amended resolution that more clearly identifies the legal <br />description of the vacated portion of County Road "D" in connection with the proposed <br />redevelopment at 3116 F airview Avenue North. <br /> <br />2.0 Staff Comment/Findings <br /> <br />2.1 On March 22, 1999, the Roseville City Council approved the request by Mr. Ric Cox for the <br />vacation of a 7.5 foot portion of County Road "D" and its attached resolution. However, <br />after a subsequent review of the site plan, it was discovered that a small portion of the <br />existing structures roof encroached into the County Road "D" right-of-way and was not <br />covered by the original legal description. <br /> <br />2.2 This inadvertent mistake has no additional impact to the adjacent property owners and is <br />necessary to allow Mr. Cox to proceed with his development plans. <br /> <br />2.3 Staff has sought the advice of the City Attorney who recommended staff present a revised <br />resolution to the City Council for readoption of the new legal description. <br /> <br />3.0 Staff Recommendation <br /> <br />Based on the findings outlined in Section 2 of this report, staff recommends approval of Ric <br />Cox's request for vacation of a portion of County Road" D" , including the amended legal <br />description of said vacation, for property located at 3116 Fairview Avenue. <br /> <br />4.0 Suggested Council Action <br /> <br />By resolution, (attached) approve the Ric Cox request for vacation of a portion of County <br />Road "D" approximately 7-112 feet wide by 155.99 feet in length, directly east of Fairview <br />Avenue adjacent to property located at 3116 Fairview Avenue North, based on fmdings listed <br />in Section 2 of the Request for Council Action dated 4/26/99. <br /> <br />The City records the vacation after final approval. <br /> <br />PF3092 - RCA (04-26-99) - Page 1 of2 ~ <br /> <br />~.O\ <br />~)~ <br />
