<br />~ <br /> <br />3.0 <br /> <br />Planned Unit Development Approval <br /> <br />3320009 <br /> <br />The CITY hereby grants approval of the final deve10pment plan for Cox Insurance Associates, <br />Incorporated, subject to the DEVELOPER's compliance with the terms and conditions of this agreement. <br />The CITY agrees to approve applications for building permits, provided that said plans are consistent <br />with the exhibits which were approved at the concept and final stage of the Planned Unit Development <br />process (located in Appendix A), the DEVELOPER has not defaulted, and all of the standards and <br />conditions of this agreement have been satisfied. <br /> <br />For three (3) years from the date of this Agreement, no amendments to the CITY'S Comprehensive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless required by <br />state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any improvements <br />proposed thereafter, notwithstanding anything in this Agreement to the contrary, the CITY may require <br />compliance with any amendments to the City's Comprehensive Guide Plan, official controls, platting <br />or dedication requirements enacted after the date of this Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD for Cox Insurance Associated, Incorporated, the <br />CITY hereby incorporates the following exhibits. The DEVELOPER shall develop the subject property <br />as described or shown in these exhibits. If the exhibits vary from the written terms of this Agreement, <br />the written terms shall control. In the event the exhibits address items not specifically addressed in this <br />" agreement, the exhibits shall govern with respect to those items: The exhibits marked as approved by <br />the City Council on March 22,1999, or as amended thereafter, shall include: <br /> <br /> Exhibit A <br /> Exhibit B <br /> Exhibit C <br />... <br />- <br /> Exhibit D <br /> Exhibit E <br /> Exhibit F <br /> Exhibit G <br /> <br />Certificate of Survey of the property lines with the vacation of County Road "D" right-f- <br />way shown. and all existing site improvements dated February 5, 1999. <br /> <br />Site plan with existing conditions, proposed addition, sidewalk, parking, fence detail, and <br />monument sign detail, dated AprilS, 1999 <br /> <br />Grading, drainage, and utility plan illustrating existing grades and those proposed after <br />completion of the proposed construction, drainage directions, spot elevations, catch <br />oasins for.surface water catchment, sanitary sewer line, and watermain, dated May 22, <br />1999. <br /> <br />Complete Landscape Plan (subject to minor change) with materials list, sizes, and <br />locations of all plant materials, dated March 10, 1999. <br /> <br />Building floor plans of basement and main level, including rood designations and overall <br />dimensions, datedAprilS, 199~ <br /> <br />Building elevations with height dimensions and building materials dated April 9, 1999. <br /> <br />Development schedule with installation dates of all improvements and proposed date <br />of occupancy, dated June 9,1999. <br /> <br />2 <br />
