<br />4.0 <br /> <br />Rezoning <br /> <br />3320009 <br /> <br />The CITY conducted hearings and meetings on December 9, 1998 (Planning Commission - sketch plan <br />review), January 13, 1999 (Planning Commission - hearing on concept development plan), January 25, <br />1999 (City Council - action on concept), March 10, 1999 (Planning Commission - hearing/action action <br />on vacation of right-of-way), March 22,1999 (City Council- meeting and action on final development <br />plan and vacation of right-of-way, and action on PUD agreement) to consider various aspects of the <br />Planned Unit Development, including rezoning of the subject property from B-3, General Business <br />Disti'ict to Business-Planned Unit Development (B-PUD). The CITY agrees to rezone the subject <br />property to Business-Planned Unit Development (B-PUD), subject to the DEVELOPER's strict <br />compliance with the approved plans, and the terms and conditions of this agreement. Minor variations <br />from the approved final development plans, which are consistent with this agreement and the <br />underlying B-1 zoning district, may be approved by the CITY's Development Review Committee, under <br />the direction of the Community Development Director. Substantial departures from the approved final <br />development plans will require an amendment to the Planned Unit Development in accordance with <br />Section 1015 of the Roseville Zoning Ordinance. Where not superseded by more restrictive requirements <br />of this PUD, the standards of the underlying B-1 (Limited Business) zoning district shall apply, as stated <br />in Chapter 1005 of the Roseville City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the DEVELOPER to commence development activity, in accordance with the final <br />development plans, within one year following the final approval of this Planned Unit Development, will <br />--' necessitate the approval of an extension of the development schedule by the City COuncil prior to the <br />expiration of the one year period. If an extension is not applied for, the Council may instruct the <br />Planning Commission to initiate rezoning to the original B-3 zoning district. For purposes of this <br />provision, development activity shall be defined as obtaining a building permit and beginning <br />construction on the site. Development of the property and installation of improvements shall be in <br />accordance with the development schedule provided by the DEVELOPER and approved by the CITY <br />(Exhibit F). <br /> <br />-- - -:::'," <br /> <br />_::-,: ~-.7.0_ . ,Compl_iaJlce with Laws and Regula~oDs " <br /> <br />-- <br /> <br />The DEVELOPER represents to the CITY that any site improvements pursuant to the proposed <br />Development will comply with all City, County, Regional, Metropolitan, State, and Federal laws and <br />regulations, including but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />Regulations, and all other applicable environmental regulations. The DEVELOPER agrees to comply <br />with a11 such laws and regulations. <br /> <br />'8.0 Site Development Requirements <br /> <br />To ensure that the proposed development meets the CITY'S requirements and standards for site <br />development, the following provisions shall apply: <br /> <br />3 <br />
