(PF3096) <br /> <br />1.0 Requested Action <br /> <br />Manager Approved: <br /> <br />1.1 Lyndale Garden Center (tenant) and Capitol City Investments, Ltd (owner) of the site at <br />2525 North Snelling Avenue request approval of a conditional use permit to display, sell, <br />and store exterior materials adjacent to the front (east) and sides (north and south) of the <br />existing 9,875 sJ. building. The parcel is 81,450 sJ. (1.87 acres). The purpose of this display, <br />sales, and storage is to display for sale, seasonal landscape and plant materials. In addition <br />to the conditional use permit request, the applicants are requesting a height variance to <br />allow a 6-foot high wrought iron fence in a front yard where a 4-foot fence height is the <br />requirement for security and safety purposes. <br /> <br />2.0 Background <br /> <br />2.1 The conditional use permit process (Section 1013 of the City Code) for this request allows <br />the City to consider: <br />. compatibility with adjoining properties; <br />. impacts on traffic and public facilities, <br />. impacts on property values; <br />. impact on the general health, safety, and public welfare; <br />. compatibility with the City's comprehensive plan. <br />. The process also allows the City to impose those conditions it considers necessary <br />to protect the public health, safety, and welfare. <br /> <br />2.2 Section 1005.01 G3 allows outdoor display of merchandise by conditional use permit. The <br />Planning Commission and the Council must determine the impact of the display on adjacent <br />properties and the community as a whole as follows: <br /> <br />a. the percent of outdoor sales area compared to the amount of indoor sales space <br />b. the location of the outdoor sales and the extent to which it encroaches on required <br />setbacks <br />c. the impact of traffic and pedestrian circulation on the site <br />d. the impact of parking on the site <br />e. the height of the merchandise displays <br />f. the hours of merchandise display <br />g. the type of merchandise displayed <br /> <br />PF3096 - RCA (02-22-99) - Page 1 of6 G.Q\ <br />9-<< <br />{~r~ <br />
