Request For Council Action Date: 03/22/99 Item No: t Approval: Agenda Section: LAND USE Lyndale Garden Center is requesting a conditional use permit for outdoor display/sales and is requesting fence variances for side yard setback and height around the outside sales area. (PF3096) Manager Approved: At the February 22, 1999 meetin~ the Council directed the staff to review any additional options that may be available and return to the Council with findings of fact and a resolution to extend the review time (if additional study time was needed). On March 12,1999, the Council extended the review period for up to 60 days (Resolution 9636), with the intent to work with the applicant to resolve traffic issues relating to Oakcrest Avenue and complete the study of the left turn capacity on Snelling and on Fairview. The study has been completed by Short Elliott Hendrickson and was discussed in detail at the work session on March 15, 1999. The following items are attached: ~ The original staff report and Planning Commission recommendations. ~ A Resolution (with conditions) approving the Conditional Use Permit. ~ A Resolution (with conditions) approving the Variance. Should the Council decide to not approve the permit or variance, the decision should be tabled and the City Attorney provided direction on issues to be included in the findings of fact for a denial. 60-Day Schedule: The application was accepted as complete on January 11,1999. The deadline for a decision by the City Council is May 22,1999.
