REQUEST FOR CITY COUNCIL ACTION

DATE: 4/26/99
ITEM NO: J-l

roval:

11anagerApproved:
~

Agenda Section:
LAND USE

Bradley Operating Limited Partnership (for Cub Foods) request for vacation
of a portion of certain utility and drainage easements in connection with the
rerouting of utility lines located on the southeast side of the former
Homeplace, in Har Mar Mall at 2100 Snelling Avenue. (PF31 04).

At the March 22, 1999 meeting, the City Council continued action on this item
until the date specific of April 26, 1999. At the same meeting the City Council
also adopted an Interim Ordinance (moratorium) and modified it on April 12 as
Ordinance No 1220, temporarily prohibiting development for certain parcels
within" SC" (shopping center) zoning districts.

1.0 REQUESTED ACTION

1.1 Bradley Operating Limiting Partnership is requesting the vacation of certain utility and
drainage easements located southeast of the former Homeplace structure within the parking
lot of Har Mar Mall. (legal description attached)

2.0 BACKGROUND

2.1 This specific request by Bradley Operating Limited Partnership is based on their future plans
to redevelop the former Homeplace store with a 75,000 + square foot Cub Food grocery
store. The proposal calls for a new utility easement to be established directly adjacent the
current easement and for the existing utilities to be relocated to the new easement. Once
relocated, the existing easement area identified on the attachment will no longer be needed.

2.2 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A public
hearing is required. The Planning Commission holds the hearing and recommends a vacation
action to the City Council.

3.0 STAFF COMMENT

3.1 Previously, staffhad indicated that the proposed easement was adequate to accommodate the
reconstruction of the existing utilities and that the Engineering Department would continue
to work with Westwood Professional Services on an acceptable utility design. The recent
enactment of the moritorium affecting this parcel has changed our position. Because it is
uncertain whether the moratorium study and report will impact or affect the proposed Cub
Food, staff is of the opinion that the vacation request is premature.

PF3104 - RCA (04-26-99) - Page 1 of 2

'\ cb'C\~
