<br />4.0 STAFF RECOMMENTATION <br /> <br />4.1 Based on the finding outlined in Section 3.1 of this report, staff recommends denial of the <br />request for vacation of certain utility and drainage easements located on the southeast side <br />of the former Homeplace facility in Har Mar Mall, 2100 Snelling A venue. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 On March 10, 1999, after holding the required public hearing, the RoseviIIe Planning <br />Commission recommended approval (5-1) of the request for vacation of certain utility and <br />drainage easements located on the southeast side of the former Homeplace facility and <br />acceptance of a replacement utility easement, based on the findings outlined in Section 3.1 <br />of this report. <br /> <br />5.2 The Planning Commission action, however, is substantially affected by the adoption ofthe <br />interim ordinance. <br /> <br />6.0 SUGGESTED COUNCIL ACTION <br /> <br />By resolution (draft attached) deny Bradley Operating Limited Partnership's (for Cub Foods) <br />request for vacation of a portion of certain utility and drainage easements in connection with <br />the rerouting of utility lines located on the southeast side of the former Homeplace, in Har <br />Mar Mall at 2100 Snelling Avenue. <br /> <br />Attachments: Property location map; location of existing easements; and proposed easement and sketch. <br />60-day Time Limit: Not applicable <br />Prepared by: Thomas Paschke (490-2236) <br /> <br />Q:\Planning Files\31 04_ Cub F oods\RCA _vacation (042699) <br /> <br />PF3104 - RCA (04-26-99) - Page 1 of 2 <br />
