<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 3/22/99 <br />ITEM NO: J-5 <br /> <br />Agenda Section: <br />LAND USE <br />Bradley Operating Limited Partnership (for Cub Foods) request for vacation <br />of a portion of certain utility and drainage easements in connection with the <br />rerouting of utility lines located on the southeast side of the former <br />Homeplace, in Har Mar Mall at 2 I 00 Snelling Avenue. (PF31 04). <br /> <br /> <br /> <br />1.0 Requested Action <br /> <br />1.1 Bradley Operating Limiting Partnership is requesting the vacation of certain utility and <br />drainage easements located southeast of the former Homeplace structure within the parking <br />lot of Har Mar Mall. (legal description attached) <br /> <br />2,0 Background <br /> <br />2.1 This specific request by Bradley Operating Limited Partnership is based on their future plans <br />to redevelop the former Homeplace store with a 75,000 + square foot Cub Food grocery <br />store. The proposal calls for a new utility easement to be established directly adjacent the <br />current easement and for the existing utilities to be reconstructed within the new easement. <br />Based on the proposed plan and the provision of a utility easement prior to the relocation <br />of utilities, the existing easement area identified on the attachment will no longer be needed. <br /> <br />2.2 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A public <br />hearing is required. The Planning Commission holds the hearing and recommends a vacation <br />action to the City Council. <br /> <br />3.0 Staff Comment <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />The RosevilIe Engineering Department has reviewed and provided comments to Westwood <br />Professional Services regarding the proposed design of relocated utilities. It has also <br />determined that the proposed easement is adequate to accommodate the reconstruction of the <br />existing utilities.
