<br />Extract of Minutes from Planning Commission meeting of April 14, 1999: <br /> <br />RE: <br /> <br />Boaters Outlet, Inc., 2205 West County Road C2, request for a <br />Interim Use Permit. (PF3111) <br /> <br />Chair Klausing opened the hearing and requested a staff summary of the april14, 1999 <br />report by City Planner Thomas Paschke. <br /> <br />Thomas Paschke explained the interim use permit and the request to create an "owner- <br />to-buyer" lot. The zonIng and Comprehensive Plan are industrial. The 1.9 acre site and <br />its impacts were reviewed based on the staff report and applications. <br /> <br />Access is from County Road "C-2", mostly used for boat storage in winter as allowed by <br />a previous interim use permit. Thomas Paschke described internal circulation and <br />parking; landscaping will include repaired sod. <br /> <br />Member Cunningham asked for details on the letter from M.A.D.A. (4.9.99) which is in <br />the record. Chair Klausing read the letter into the record. Thomas Paschke reported <br />on the city attorney's opinion. <br /> <br />Member Olson noted that the Palmer Trucking building needed painting, but asked if <br />the L. A. car building should also be painted. Staff should review this. <br /> <br />Member Olson noted that a rusted metal sign on the south side should be removed. <br /> <br />Member Olson asked for correction ofthe placement of dumpsters along C-2 and on <br />Partridge. <br /> <br />Member Mulder asked if they are owned by the same owner (Yes) and the applicant will <br />lease space. <br /> <br />Glen Kloskin, Boater's Outlet, is the leasor ofthe land owned by James Trapp. Mr. <br />Kloskin agreed there is a need for painting of the buildings. No buildings can be built <br />under the high electric lines or over the top of the oil pipelines. <br /> <br />Member Mulder asked if the applicant is not the owner, how do we enforce <br />requirements on to a third party? Accountability lies with the property owners. <br /> <br />Chair Klausing asked how can we require the leasee to fix up property. <br /> <br />Thomas Paschke noted that by State law the property owner signs application. <br /> <br />Member Mulder suggested we have requirements for other leasees based on this <br />applicant. Thomas Paschke advised the staff is doing that. This is one way to get them <br />to comply. Member Mulder asked why aren't we dealing with this as a Code violation <br />rather than a permit application and why were we tying up this applicant's <br />opportunities with Code violations of the property owner. <br /> <br />~,~C\ <br />v\~ <br />
