<br />Thomas Paschke clarified the City's position. <br /> <br />Applicant stated he hoped Code violations would not interfere with his use and he <br />would like to encourage the Planning Commission to pursue clean-up. <br /> <br />Member Klausing referred to Item 9, hours of operation. What happens if vehicles are <br />not gone by Sunday evening? Thomas Paschke advised this would be similar to <br />enforcement of a conditional use permit. The City wants to avoid storage on the site <br />and would limit the use to weekends only. <br /> <br />Member Cunningham felt it was a hardship for the tenant to be forced to suffer for the <br />property owner's code violations, but the city needs to get the landlord's attention. <br />What can the city do? Would the city tow? Member Rhody advised the Council can <br />discontinue the interim use permit for violations. <br /> <br />The applicant advised hours of 4:00 - 7:00 p.m. on Friday evenings and early Saturday <br />for drop-offs; closed on Sundays at 4:00 p.m. and cars out by 5:00 p.m. on Sundays. <br />Sometimes the car will be there overnight. The agreement will ask for a "storage fee". <br /> <br />Chair Klausing declared the hearing closed at 10:45 p.m.. <br /> <br />Gary Wood, 360 W. Owasso Blvd., advised he was a business partner ofthe applicant <br />and a character witness. <br /> <br />The applicant stated for dust control, thermal gas/calcium chloride, which is harmless, <br />would be used. <br /> <br />Member Cunningham asked what would preclude dealers from displaying/selling cars <br />on the site. Clear title must be displayed to determine if a dealership is using the lot. <br /> <br />Motion: Member Mulder moved, seconded by Member Cunningham, to recommend <br />approval of the Boaters Outlet request for an interim use permit to allow a "owner to <br />buyer lot" on the vacant 1.92 acre parcel adjacent 2205 West County Road C2, based on <br />the findings and conditions 9 through 22 listed in Section 3 of the Request for <br />Commission Action dated 4/14/99, and further that the activity shall be restricted to <br />the time period, each year, from May 1 to October 1. <br /> <br />Member Olson asked for clarification of the duration of "summer months (May - <br />September).
