The cost for these <br />improvements shall be the soJe expense of the Developer. <br />Arcade Street Extension <br />The City recently ordered in the extension of Arcade Street from approximately 750 <br />feet south of County Road E to Berwood Avenue West. It is anticipated that the <br />contract for this improvement will be let in February to April of 1995. No building <br />permit will be issued for this development until a contract has been signed for the <br />Arcade Street extension and no occupancy penT1it will be issued until the watennain <br />loop is completed from BelWoOd Avenue West to County Road E. This paragraph is <br />associated with Article 13 A of this Agreement. <br />Realignment of County Road ElKoehler Road and Centerville Road and Sidewalks <br />The City anticipates realigning County Road E and Koehler Road at Centerville Road <br />and adding sidewalks in the area. The City anticipates using tax increments generated <br />from the Fontana Development to finance this improvement. However, because the <br />City directly controls the timing of planning and constructing these improvements and <br />because Ramsey County has approved a pennanent all-way stop at this intersection, <br />building permits or occupancy permits will not be delayed by this City improvement. <br />County Road ElBride:e ImRrovements ' <br />The City of Vadnais Heights, jointly with other governmental agencies, made <br />significant improvements to County Road E, the subject improvements financed <br />through bonds. The Developer agrees to pay the County Road E improvement <br />assessments (ineluding Improvements No. 92-9 and 92-1) in full within three years of <br />the first occupancy permit issued for this development. <br /> <br />F. <br /> <br />G. <br /> <br />H. <br /> <br />Article 14 <br />The following requirements of the City Engineer shall be adhered to: <br /> <br />A. <br /> <br />The final plat shall include: <br />1. Necessary road right-of-way dedication, required by the Engineer and Ramsey <br />County on County Road E. <br />2. A utility/drainage easement over Dudot C. <br />3. Utility easements over all sanitary sewer mains, watermains, and stonn sewers <br />as the City will do light maintenance on sanitary sewer and municipal water <br />(such as flushing mains), but all major repairs (such as digging up mains, etc.) <br />shall be the responsibility of the Developer/future owner. <br />Written permits (rom both VLAWMO and the Corps of Engineers shall be .submitted <br />for altering wetlands before any grading takes place. <br />The City Engineer shall review and approve all plans and specifications of site utilities, <br />storm water pond, any modifications to County Road E (including signalization) and <br />typical driveway/parking lot/sidewalk sections.
