VADNAIS SQUARE <br /> <br />DEVELOPMENT AGREEMENT <br /> <br />Article 27 <br />The site shall be maintained on a regular basis that is not detrimental to surrounding <br />properties and the environment, and shall be maintained in a manner that sets a high <br />standard. Landscape materials are required to be maintained and replaced within three years <br />of completion of a phase, except for the westerly buffer area which is addressed in Article 12 <br />E. The outlot sites, prior to construction shall be maintained in a reasonable manner, <br />including cut on a weekly basis during the growing season. The entire site, including the <br />boulevard area along County Road E shall be maintained. All utilities shall be maintained in <br />. a manner that meets City requirements. The pond shall be maintained to meet storage and <br />water quality requirements. <br /> <br />Article 28 <br />The Developer must secure all necessary review permits, water meters, ete. from the City and <br />State agencies. <br /> <br />Article 29 <br />Minnesota Statutes, Chapter 505.02, Subdivision 1, has been amended. The Placement of <br />durable iron monuments for marking of platted lots, blocks and boundaries must be set <br />within one year of the recording of a plat or parcel and the City is required to check the <br />placement of monuments. The City has a contract with the Ramsey County 5U1veyor to do <br />the field check. The Developer is required to reimburse the City for any costs from the <br />County for placement of iron monuments. Ramsey County will estimate the cost and the <br />City will inform the Developer of the estimated amount. The Developer will be required to <br />escrow with the City, within ten days of being notified by the City, the estimated cost for this <br />field checking. Any difference in the actual charge and the Developer's escrowed amount <br />must be resolved within 30 days of the City notifying the Developer. <br /> <br />Article 30 <br />Upon all plans and issues in this agreement being addressed, the City Administrative and <br />Building Department staff will issue building permits. <br /> <br />Article 31 <br />It is anticipated that the two sitadown restaurants may need on-sale liquor licenses. The City <br />will reserve two on-sale and one off-sale liquor licenses for this development until December <br />31, 1998. <br /> <br />Artide 32 <br />The above conditions are in addition to other existing' City Code or other State Or <br />governmental unit regulations. Where articles of this Agreement are inconsistent with such <br />codes or regulations, this Agreement will apply. <br /> <br />'. . \- <br /> <br />~ 10- <br />
