(PF3l77) <br /> <br /> <br />1.0 Background <br /> <br />1.1 At the Monday, December 13, 1999 City Council meeting the Council received <br />additional written and oral comments on proposed amendments to the City Code <br />relating to nighttime business uses and activities in Shopping Center Districts. <br />Following the staff and consultant reports and receipt of resident and business <br />testimony, the Council discussed the proposed amendments. Subsequently, the <br />Council voted to table further deliberation and possible action on the proposed <br />ordinance until Wednesday, December 15, 1999. <br /> <br />1.2 In order to facilitate discussion and a decision regarding this proposal, staff has <br />attached a "clean" copy of the ordinance as recommended by the Planning <br />Commission, which was included in the Monday meeting agenda packet as <br />Attachment C, and is recommending that the Council consider additions and <br />deletions to the draft addressing the concerns raised at the Monday meeting. <br />These suggested revisions are shown by strike and underline type fonts, and <br />include additional punctuation and grammatical modifications as well as <br />substantive provisions. <br /> <br />2.0 Proposed Ordinance-Areas of Concern/Remaining Issues <br /> <br />2.1 Review process. The ordinance proposes two processes for approval. Under the <br />first process, the staff would review minor amendments to the master shopping <br />center plan, which include changes in the building cube which are less than a <br />10%. As indicated in the record, this is consistent with the City's previous and <br />current practices. The second process would require a conditional use permit for <br />any new structure or expansion of an existing structure that increases the cube of <br />the building or structure by more than 10% of its current area. The conditional <br />use permit process also addresses major issues that could potentially impact <br />residential areas directly adjacent to the Shopping Center Districts. <br />Councilmember Wiski and others raised concerns that significant off-site impacts <br />could be expected with or without major additions to the cubic area of the <br />structure or changes in hours of operation to include 24-hour uses. Specifically, <br />activities such as additional ingress and egress points for vehicles, parking lot <br />capacity modifications, and trip generation were discussed. <br /> <br />RCA(121599),docPage 1 of 4 <br />
