June 11, 1999 Michael and Mary Dietz 373 Maple Lane Court Roseville, Minnesota 55113 HE: Request for a driveway Setback Variance Dear Mr. and Mrs. Dietz: The Planning Commission, at their meeting ofJune 9, 1999, reviewed your application for a variance from Section 703.04 of the City Code relating to reduction of the required driveway access point setback from a street corner from 30 feet to 21 feet. This request is prompted by the City's pavement Management Plan and reconstruction of Maple Lane court. Based on staff findings outlined below, the Planning Commission recommended your request be approved: Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that no practical alternatives exist that would reduce the need for a variance. The grade of the existing driveway exceeds the City's current threshold of 10% and if relocated the new driveway would be even greater in order to match into the garage and roadway. Relocating the driveway would not allow ample room to properly taper the driveway to the garage and would require the utilization additional front yard area. The proposed variance, if granted, will not adversely affect the public health, safety, or general welfare, provided standards/conditions are attached to insure that redevelopment of the site is completed in accordance with the plans proposed by the applicant Your application, together with the Planning Commission's recommendation, will be forwarded to the City Council on Monday, June 29th for final action. The City Council meeting starts at 6:30 p.m., and is held in the Council Chambers of the City Hall.
