<br />... <br /> <br />3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.4 The grade ofthe existing driveway exceeds a slope of 10% and if relocated the new <br />driveway would be even greater in order to match into the garage and roadway. <br /> <br />3.5 Relocating the driveway would require the new driveway location to be approximately in <br />the center of the lot and given the location of the home, would not allow ample room to <br />properly taper the driveway to the garage. The modification would also require major <br />site work and loss of front yard area. <br /> <br />3.6 The proposed variance, if granted, will not adversely affect the public health, safety, or <br />general welfare, provided standards/conditions are attached to insure that redevelopment <br />of the site is completed in accordance with the plans proposed by the applicant. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outlined in Section 3.2,3.4,3.5 and 3.6 of this report, staff <br />recommends approval of the request for a variance from Section 703.04B(4) of the City <br />Code to reduce the require driveway access point (apron) setback for property located at <br />373 Maple Lane Court from 30 feet to 21 feet or a nine (9) foot variance. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />On June 9, 1999 the Roseville Planning Commission held a public hearing regarding Mr. <br />Dietz's request for a nine (9) foot variance. At this hearing, no citizen addressed the <br />Commission indication opposition or approval of the request.
