<br />NOW, THEREFORE, the Declarant hereby declares that all of the property described <br />above shall be subject to this Declaration set forth below and the terms and conditions of said <br />Declaration shall run with the real property and be binding on all parties having any right, title <br />or interest in the above described properties or any part thereof, their heirs, successors, and <br />assigns and shall inure to the benefit of each Owner thereof. <br /> <br />ARTICLE I <br />DEFINITIONS <br /> <br />Section 1. <br />Homeowners Association <br />Minnesota Statutes. <br /> <br />"Association" shall mean and refer to Woods Ed~e Townhomes <br />Said Association has been incorporated under Chapter 317 A of <br /> <br />Section 2. "Property" shall meaIl and refer to all the real property submitted <br />to this Declaration, including the Buildings and all other structures and improvements located <br />thereon now or in the future. The Property as of the date of this Declaration is legally <br />described as follows: <br /> <br />(Ramsey County Property) <br /> <br />Lots 1 through 11, Block I, Woods Edge Townhomes <br /> <br />(Hennepin County Property) <br /> <br />Lots I through 3, Block 1, Woods Edge Townhomes <br /> <br />Section 3. "Board" shall mean the Board of Directors of the Association <br />as provided in the By-Laws. <br /> <br />Section 4. "By-Laws" shall mean the By-Laws governing the operation of <br />the Association as amended from time to time. <br /> <br />Section S. "Common Elements" shall mean and refer to all real property <br />and improvements located thereon which hereafter may be acquired by the Association for the <br />common use and enjoyment of the owners. The Common Elements are legally described as: <br /> <br />(Ramsey County Property) <br /> <br />Lots' I through II, Block I, Woods Edge Townhomes <br /> <br />(Hennepin County Property) <br /> <br />Lots 1 through 3, Block 1, Woods Edge Townhomes <br /> <br />Section 6. "Lot" shall mean and refer to any Lot shown upon any recorded <br />plat of Townhomes with the exception of common elements or public area, and shall include <br />any buildings located on a lot. For the purpose of this Declaration the term "Lot" shall carry <br />the same meaning and be a substitute for the term "Unit" as defined in Minnesota Statute, <br />Section 5158.1-103(33). The boundaries of the Lot shall be the boundaries shown on the <br />recorded plat known as Stewart Bluff, there being no upper or lower boundaries, and each Lot <br />shall be identified by the Lot Number and Block Number, shown on the recorded plat known <br />as Stewart Bluff. 2 <br />
