<br />ARTICLE IV <br />THE COMMON ELEMENTS <br /> <br />Section 1. Common Elements. The common elements of this property shall <br />be legally described as follows: <br /> <br />(Ramsey County Property) <br /> <br />Lots 1 through 11, Block 1, Woods Edge Townhomes <br /> <br />(Hennepin County Property) <br /> <br />Lots I through 3, Block 1, Woods Edge Townhomes <br /> <br />And shall include all personal property improvements located thereon. <br /> <br />Section 2. Association Rie:hts and Duties. The Association, subject to the <br />rights of the Owners set forth' in this Declaration, shall be responsible for the exclusive <br />management, control, repair and maintenance of the Common Elements and all improvements <br />thereon, and to the degree hereinafter specified to the exteriors of units and the yard areas. <br />For the purpose of preserving the architectural character, quality, and uniform high standards <br />for appearance of the property, the Association shall (i) provide for exterior maintenance upon <br />the Building located on each Lot which is subject to assessment as follows: paint and replace <br />roof, gutters, downspouts, decks, garage doors ( except hardware), and exterior siding and other <br />building services, (ii) provide for lawn, shrub and tree maintenance on all Lots, except <br />watering, (iii) provide for a driveway, walkway and bridge maintenance, and (iv) provide for <br />maintenance of all personal property located on the common elements, including but not <br />limited to all playground equipment. <br /> <br />Section 3. Services. The Association may obtain and pay for the services <br />of any person or entity to manage its affairs, or any part thereof, to the extent it deems <br />advisable, as well as such other personnel as the Association shall determine to be necessary <br />or desirable for proper operation whether such personnel are furnished or employed directly <br />by the Association or by any person or entity with whom or which it contracts. The <br />Association may obtain and pay for legal and accounting services necessary or desirable in <br />connection with the operation of the properties or the enforcement of this Declaration. The <br />Association may arrange trash collection, snow removal, and other common services to <br />Owners, and to maintain exteriors, yard areas and driveways. <br /> <br />Section 4. Personal Property for Common Use. The Association may <br />acquire and hold for the beneficial use and enjoyment of all of the Owners, tangible and <br />intangible personal property, and may dispose of the same by sale or otherwise. <br /> <br />Section 5. Easement for Overhane:s and Porches. As part of the original <br />construction of a living unit the Declarant intends to construct porches, fireplaces and other <br />overhangs which may encroach upon the Common Elements. The Owners of any Lot to <br />which is attached a porch, fireplace or other overhang which encroaches on the common <br />elements shall be granted an exclusive easement over and across the common elements to <br />maintain the encroachment. An easement shall also be granted for any encroachment resulting <br />from any reconstruction, alterations allowed pursuant to Article VIII hereof, repair, settlement <br />or movement.
