<br />'." <br /> <br />For two (2) years from the date of this Agreement, no amendments to the CITY's Comprehensive <br />Guide Plan or official controls shall apply to, or affect the use, development density, site layout, <br />or dedication requirements of the land included within the Planned Unit Development, unless <br />required by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For <br />any improvements proposed thereafter, notwithstanding anything in this Agreement to the <br />contrary, the CITY may require compliance with any amendments to the City's Comprehensive <br />Guide Plan, official controls, platting or dedication requirements enacted after the date of this <br />Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD for the lO-unit townhouse development for <br />the DEVELOPER, the CITY hereby incorporates the following exhibits. The DEVELOPER shall <br />develop the subject property as described or shown in these exhibits. If the exhibits vary from the <br />written terms of this Agreement, the written terms shall control. In the event the exhibits address <br />items not specifically addressed in this agreement, the exhibits shall govern with respect to those <br />items. The exhibits as approved by the City Council on July 26, 1999, or as amended thereafter, <br />shall include: <br /> <br />Exhibit A. Certificate of Survey of the parcel including property lines, existing conditions, and <br />utilities. <br /> <br />Exhibit B. Certificate of Survey of the parcel indicating the townhouse lot limits, proposed <br />structure foot print (including decks & patios), proposed structure first floor <br />elevation, parking areas and drive lanes, dated December 7 and December 9, <br />1999. <br /> <br />Exhibit C. Final plat of Roseville Commons East, indicating parcel limits and lots dimensions. <br /> <br />Exhibit D. Final site plan indicating all applicable setbacks, drive lane width, and town home <br />footprints, dated September 28, 1999. <br /> <br />Exhibit E. Final grading and utility plan, dated June 21, 1999. <br /> <br />Exhibit F. Final landscape plan (subject to minor change) with materials list, plant sizes, fence <br />detail (if required), and additional visitor parking, dated September 30, 1999. <br /> <br />Exhibit G. Final building elevations indicating all facade materials and structure height, roof <br />plan indicating structural components and pitch detail, dated May 20 and October <br />4, 1999. <br /> <br />Exhibit H. Building floor plans of basement and main level, including overall dimensions, <br />dated May 20 and October 4, 1999. <br /> <br />2 <br />
