<br />Exhibit I. Development schedule with installation dates of all improvements including <br />beginning date, grading, footings, building construction, paving, landscaping and <br />proposed date of occupancy, dated November 5, 1999. <br /> <br />Exhibit J. Site and building lighting and signage plan, dated November 5, 1999. <br /> <br />Exhibit K. Perpetual ponding and flow easement, dated August 25, 1999. <br /> <br />Exhibit L. Draft Homeowners Association by-laws and covenants, dated October 19, 1999. <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on July 14, 1999 (Planning Commission - hearing on <br />concept development plan & preliminary plat) and July 26, 1999 (City Council - hearing and <br />action on conceptlfinal development plan, preliminarylfinal plat, and action on PUD agreement) <br />to consider various aspects of the Planned Unit Development, including rezoning of the subject <br />property from B-1, Limited Business District to Residential-Planned Unit Development (R-PUD), <br />with an underlying zoning of R-6, Townhouse District. The CITY agrees to rezone the subject <br />property to Planned Unit Development (PUD), subject to the DEVELOPER's strict compliance <br />with the approved plans, and the terms and conditions of this agreement. Minor variations from <br />the approved final development plans, which are consistent with this agreement and the underlying <br />R-6 zoning district, may be reviewed by the CITY's Development Review Committee and <br />approved by the Community Development Director. Substantial departures from the approved <br />fmal development plans will require an amendment to the Planned Unit Development in <br />accordance with Section 1015 of the Roseville Zoning Ordinance. Where not superseded by more <br />restrictive requirements of this PUD, the standards of the underlying R-6 (Townhouse District) <br />zoning district shall apply, as stated in Chapter 1004.08 of the Roseville City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the DEVELOPER to commence development activity (obtaining a building permit and <br />beginning construction on the -site), in accordance with the final development plans within one year <br />from the approval date (July 26, 2000) of this Planned Unit Development Agreement, will <br />necessitate the approval of an extension of the development schedule by the City Council prior to <br />the one year expiration date. Failure to obtain an extension to the development will terminate <br />the approved PUD Agreement, for which the Roseville City Council may instruct the Planning <br />Commission to initiate rezoning the subject property to R-6, Townhouse District. <br /> <br />3 <br />
