<br />City Of Roseville <br />Planned Unit Development Agreement # <br />(Roseville Commons East Townhouse Development) <br /> <br />AGREEMENT, dated July 12, 1999, between the City of Roseville, a Minnesota municipal <br />corporation (herein referred to as "CITY"), and Mendota Homes, Incorporated, P.O. Box 416, Forest <br />lake, Minnesota 55025 (herein referred to as "DEVELOPER"). <br /> <br />1.0 Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: I) passage and publication of <br />Ordinance #_ (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's <br />official newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) <br />recording of this agreement with Ramsey County. <br /> <br />A separate agreement, the Subdivision Agreement, must also be approved and recorded with the <br />final plat for the proposed II lot subdivision prior to issuance of building permits. <br /> <br />2.0 Request for Planned Unit Development Approval <br /> <br />The DEVELOPER has asked the CITY to approve an amendment to Planned Unit Development <br />(PUD) #1124 (PF#3094) for the inclusion of a 1.5 acre parcel to accommodate a 10 unit (lot), <br />rambler (with basements) town home development. The request involves the following legally <br />described properties: <br /> <br />Vacant one (1) acre parcel located approximately at 3201 Old Highway 8, (PID # <br />05292332003) City of Roseville, Ramsey County, Minnesota, legally described as <br />follows: <br /> <br />The South 125 feet of the North 525 feet of the West 330 and 4/10 feet of the <br />Northwest ~ of the Southwest ~ of Section 5, Township 29, Range 23, City of <br />Roseville, Minnesota. <br /> <br />3.0 Planned Unit Development Approval <br /> <br />The CITY hereby grants approval of the final development plan for the DEVELOPER, subject to <br />the compliance with the terms and conditions of this agreement. The CITY agrees to approve <br />applications for building permits provided that said plans are consistent with the exhibits which were <br />approved at the concept and final stage of the Planned Unit Development process and all of the <br />standards and conditions of this agreement have been satisfied. <br /> <br />For two (2) years from the date of this Agreement, no amendments to the CITY's Comprehensive <br />Guide Plan or official controls shall apply to, or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development, unless required <br />by state or federal law or agreed to in writing by the CITY and the DEVELOPER.
