improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, official controls, platting or dedication requirements enacted after the date of this Contract. 4.0 Approval by the CITY In approving the final development plan for the PUD for the 10 unit townhouse development for the DEVELOPER, the CITY hereby incorporates the following exhibits. The DEVELOPER shall develop the subject property as described or shown in these exhibits. If the exhibits vary from the written terms of this Agreement, the written terms shall control. In the event the exhibits address items not specifically addressed in this agreement, the exhibits shall govern with respect to those items. The exhibits as approved by the City Council on July 26, 1999, or as amended thereafter, shall include: Exhibit A Exhibit B Exhibit C Exhibit D Exhibit E Exhibit F Exhibit G Exhibit H Exhibit I Certificate of Survey of the parcel including property lines and all existing conditions, such as fences, trees, parking lot paving and parcel contours dated Preliminary Plat and Survey of the parcel indicating the townhouse lot limits, proposed structure foot prints (including decks & patios), proposed structure first floor elevation, curb and guttered parking areas and drive lane, and all applicable setbacks, dated Grading, drainage, and utility plan illustrating existing grades and those proposed after completion of the proposed building and paving construction, drainage directions, spot elevations, catch basins for surface water catchment, sanitary sewer lines, and water main, dated Site and building lighting plan and site signage plan, including development signage for parcel located in St. Anthony, dated Complete Landscape Plan (subject to minor change) with materials list, sizes, and locations of all plant materials, and any fence details, dated Building floor plans of basement and main level, including overall dimensions, dated Building elevations indicating all facade materials and structure height, and a roof plan indicating structural components and pitch detail dated Development schedule with installation dates of all improvements including beginning date, grading, footings, building construction, paving, landscaping and proposed date of occupancy, dated Sanitary sewer, water, and storm sewer utility easements, and parking access 2
