<br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, <br />official controls, platting or dedication requirements enacted after the date of this Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD for the 10 unit townhouse development for the <br />DEVELOPER, the CITY hereby incorporates the following exhibits. The DEVELOPER shall <br />develop the subject property as described or shown in these exhibits. If the exhibits vary from the <br />written terms of this Agreement, the written terms shall control. In the event the exhibits address <br />items not specifically addressed in this agreement, the exhibits shall govern with respect to those <br />items. The exhibits as approved by the City Council on July 26, 1999, or as amended thereafter, <br />shall include: <br /> <br />Exhibit A <br /> <br />Exhibit B <br /> <br />Exhibit C <br /> <br />Exhibit D <br /> <br />Exhibit E <br /> <br />Exhibit F <br /> <br />Exhibit G <br /> <br />Exhibit H <br /> <br />Exhibit I <br /> <br />Certificate of Survey of the parcel including property lines and all existing conditions, <br />such as fences, trees, parking lot paving and parcel contours dated <br /> <br />Preliminary Plat and Survey of the parcel indicating the townhouse lot limits, <br />proposed structure foot prints (including decks & patios), proposed structure first <br />floor elevation, curb and guttered parking areas and drive lane, and all applicable <br />setbacks, dated <br /> <br />Grading, drainage, and utility plan illustrating existing grades and those proposed <br />after completion of the proposed building and paving construction, drainage <br />directions, spot elevations, catch basins for surface water catchment, sanitary sewer <br />lines, and water main, dated <br /> <br />Site and building lighting plan and site signage plan, including development signage <br />for parcel located in St. Anthony, dated <br /> <br />Complete Landscape Plan (subject to minor change) with materials list, sizes, and <br />locations of all plant materials, and any fence details, dated <br /> <br />Building floor plans of basement and main level, including overall dimensions, dated <br /> <br />Building elevations indicating all facade materials and structure height, and a roof <br />plan indicating structural components and pitch detail dated <br /> <br />Development schedule with installation dates of all improvements including <br />beginning date, grading, footings, building construction, paving, landscaping and <br />proposed date of occupancy, dated <br /> <br />Sanitary sewer, water, and storm sewer utility easements, and parking access <br /> <br />2 <br />
