<br />easement/agreement between the parcel in Roseville (Ramsey County) and the City <br />of St. Anthony (Hennepin County), dated <br /> <br />Exhibit J <br /> <br />Homeowners Association, by-laws and covenants, dated <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on July 14, 1999 (Planning Commission - hearing on <br />concept development plan & preliminary plat) and July 26, 1999 (City Council- hearing and action <br />on concept/fmal development plan, preliminary/final plat, and action on PUD agreement) to consider <br />various aspects of the Planned Unit Development, including rezoning of the subject property from <br />B-1, Limited Business District to Residential-Planned Unit Development (R-PUD), with an <br />underlying zoning ofR-6, Townhouse District. The CITY agrees to rezone the subject property to <br />Planned Unit Development (PUD), subject to the DEVELOPER's strict compliance with the <br />approved plans, and the terms and conditions of this agreement. Minor variations from the approved <br />final development plans, which are consistent with this agreement and the underlying R-6 zoning <br />district, may be approved by the CITY's Development Review Committee, under the direction of <br />the Community Development Director. Substantial departures from the approved final development <br />plans will require an amendment to the Planned Unit Development in accordance with Section 1015 <br />of the Roseville Zoning Ordinance. Where not superseded by more restrictive requirements of this <br />PUD, the standards of the underlying R-6 (Townhouse District) zoning district shall apply, as stated <br />in Chapter 1004.08 of the Roseville City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the DEVELOPER to commence development activity (obtaining a building permit and <br />beginning construction on the site), in accordance with the final development plans within one year <br />from the approval date ( ) of this Planned Unit Development Agreement, <br />will necessitate the approval of an extension of the development schedule by the City Council prior <br />to the one year expiration date. Failure to obtain an extension to the development will terminate <br />the approved PUD Agreement, for which the Roseville City Council may instruct the Planning <br />Commission to initiate rezoning the subject property to R-6, Townhouse District. <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The DEVELOPER represents to the CITY that any site improvements pursuant to the proposed <br />Development will comply with all City, County, Regional, Metropolitan, State, and Federal laws and <br />regulations, including but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />Regulations, and all other applicable environmental regulations.
