,<'

REQUEST FOR CITY COUNCIL ACTION

DATE: 06/29/99
ITEM NO: D- 4
Agenda Section:
CONSENT
Sybil Smith driveway setback variance for property located at 3075
Woodbridge Street (PF3124).

1.0 REQUESTED ACTION

1.1 Sybil Smith is requesting a 10.3 foot variance from Section 703.04 of the City Code to
reduce the required 30 foot driveway setback adjacent a public street, to 19.7 feet.

2.0 BACKGROUND

2.1 Ms. Smith owns the property located at 3075 Woodbridge Street. The property is zoned
R-l, Single Family Residential, and the Comprehensive Plan identifies the property as
Low Density Residential.

2.2 The City's Pavement Management Program and the reconstruction of Woodbridge Street
have prompted the variance request.

2.3 The proposed reduction of this setback would enable Ms. Smith to retain her driveway in
its current location.

Code Requirement Current Location
30 feet 19.7 feet

Applicant Request
19.7 feet

Variance Required
10.3 feet

3.0 STAFF COMMENT

3.1 Section 703.04B(4) requires a minimum driveway access point (apron) setback from a
street corner of 30 feet. Based on the proposal a variance is necessary to allow the
existing driveway to remain.

3.2 Due to the City's Pavement Management Program and the reconstruction of Woodbridge
Street, Ms. Smith was required to apply for a variance if she wanted to keep her driveway
in its current location.

3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to
demonstrate that no practical alternatives exist that would reduce the need for a variance.

PF3124 - RCA(062999) Page 1 of 2
