<br />4.2 Based on the findings outlined in Section 3.2 and 3.6 of this report, staff recommends <br />denial of the request for a variance from Section 703.04B(9) of the City Code, to <br />reduce the required side yard setback from five (5) feet to zero feet for property located <br />at 2687 Woodbridge Street. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />On June 9, 1999, the Roseville Planning Commission held a public hearing regarding the <br />request by Mr. Davis, at which hearing one property owner spoke in opposition of <br />granting the side yard setback variance. His main reason is the fact that the two <br />properties with their pre-existing non-conforming driveways create a large area on paved <br />surface that looks out of place in the neighborhood. <br /> <br />The Planning Commission also questioned the granting of the side yard setback. Staff <br />responded by indicating that denying the variance would not effect/impact the pre- <br />existing non-conforming driveway setback. <br /> <br />The Planning Commission voted (5-0) to recommend denial of the request for the <br />driveway apron width variance from Section 703.04B(1) and voted (4-1) to recommend <br />denial of the request for a five foot driveway side yard setback variance for Section <br />703.04B(9). <br /> <br />6.0 SUGGESTED ACTION <br /> <br />By resolution deny (approve) the Michael Davis request for a six (6) foot driveway <br />apron with variance from Section 703.04B(1)(a) based on findings outlined in Section <br />3.7 of the report; and <br /> <br />By resolution deny (approve) the Michael Davis request for a five (5) foot driveway <br />side yard setback variance from Section 703.04B(9) based on findings outlined in <br />Section 3.2 and 3.6 of this report. <br /> <br />Attachments: Property location map; site plan indication driveway; and photos of parcel. <br />60-day Time Limit: Application accepted on May 21, 1999; Decision deadline is July 26, 1998. <br />Prepared by: Thomas Paschke (490-2236) <br /> <br />Q: \Planning Files\3126 _ Davis,Michaet Pope,Priscilla \RCA(062999).doc <br /> <br />PF3126 - RCA(062999) Page 3 of 3 <br />
