4.2 Based on the findings outlined in Section 3.2 and 3.6 of this report, staff recommends denial of the request for a variance from Section 703.04B(9) of the City Code, to reduce the required side yard setback from five (5) feet to zero feet for property located at 2687 Woodbridge Street. 5.0 PLANNING COMMISSION ACTION On June 9, 1999, the Roseville Planning Commission held a public hearing regarding the request by Mr. Davis, at which hearing one property owner spoke in opposition of granting the side yard setback variance. His main reason is the fact that the two properties with their pre-existing non-conforming driveways create a large area on paved surface that looks out of place in the neighborhood. The Planning Commission also questioned the granting of the side yard setback. Staff responded by indicating that denying the variance would not effect/impact the pre- existing non-conforming driveway setback. The Planning Commission voted (5-0) to recommend denial of the request for the driveway apron width variance from Section 703.04B(1) and voted (4-1) to recommend denial of the request for a five foot driveway side yard setback variance for Section 703.04B(9). 6.0 SUGGESTED ACTION By resolution deny (approve) the Michael Davis request for a six (6) foot driveway apron with variance from Section 703.04B(1)(a) based on findings outlined in Section 3.7 of the report; and By resolution deny (approve) the Michael Davis request for a five (5) foot driveway side yard setback variance from Section 703.04B(9) based on findings outlined in Section 3.2 and 3.6 of this report.
