<br /> 3.5 <br />r-o <br /> 3.6 <br />r- <br /> 3.7 <br />c <br /> <br />3.8 <br />~ <br /> <br />3.9 <br />---- <br /> <br />3.10 <br />~ <br /> <br />4.0 <br /> <br />4.1 <br /> <br />4.2 <br /> <br />5.0 <br /> <br />This request has been required as an outcome of Roseville's Pavement Management <br />Program and the reconstruction of Woodbridge Street. <br /> <br />Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />Staff finds no physical hardship for allowing the 32 foot wide driveway within the city <br />right-of-way and tapering the driveway to match into the existing driveway is a practical <br />alternative. This taper will require a slight modification to the existing driveway and <br />should occur on the north side of the driveway. <br /> <br />The existing driveway has been in place for many years and given the current design of <br />the garage and use of the existing driveway, it would be a hardship to require Mr. Davis <br />to replace the driveway to meet the current or a reduced setback. <br /> <br />Currently a small portion of Mr. Davis's driveway is located on the neighboring property. <br />Should the driveway be replaced in the future, the driveway shall be replaced only up to <br />the property line. <br /> <br />The proposed variance, if granted, will not adversely affect the public health, safety, or <br />general welfare, provided standards/conditions are attached to insure that redevelopment <br />of the site is completed in accordance with the plans proposed by the applicant. <br /> <br />STAFF RECOMMENDATION <br /> <br />Based on the findings outlined in Section 3.7 of this report staff recommends denial of <br />the request for a variance from Section 703.04B(1)(a) of the City Code to allow a <br />driveway width within the city right-of-way greater than 26 feet; and <br /> <br />Based on the findings outlined in Section 3.5,3.8,3.9 and 3.10 of this report staff <br />recommends approval ofthe request for a variance from Section 703.04B(9) of the City <br />Code, to reduce the required side yard setback from five (5) feet to zero feet for property <br />located at 2687 Woodbridge Street. This variance shall include the condition that upon <br />replacement of the driveway the reconstruction occur only to the property line and <br />include no encroachment into the property to the north. <br /> <br />SUGGESTED ACTION <br /> <br />By motion, deny (approve) the Michael Davis request for a variance from Section <br />703.04B(1)(a) based on findings outlined in Section 3.7 of the report; and <br /> <br />PF3126 - RPCA (06/09/99) - Page 2 of 3 <br />
