2. Given the design of the driveway and the previous modifications that have created the
non-conformity, there is no evidence of a physical hardship for allowing the 32 foot
wide driveway access point (apron) within the City right-of-way.

3. Records indicate that building permits were issued to a previous owner in 1983 for
remodeling the attached garage and for construction of the detached garage, however
no records are on file regarding the existing paved driveway surface.

4. Denying the driveway setback variance would not physically change or alter the pre-
existing non-conforming driveway. It would require the need for a variance in the
future should Mr. Davis or a future property owner want to replace or modifY the
existing driveway.

NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of
Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a variance to allow a 32 foot
wide driveway access point (apron) be denie~--thn~e (3) fuottlrivt:~ sidc yard
'8'etbAr,k mu:i~v"efl for lh~ Jii.~y for property located at 2687 Woodbridge Street be
denied.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member Wiski, and upon vote being taken thereon, the following voted in favor: Maschka, Wiski,
Mastel
and the following voted against the same: none

WHEREUPON said resolution was declared duly passed and adopted.
