(PF 3128) 1.0 REQUESTED ACTION 1.1 Joseph Duellman is requesting approval of a sign setback variance from Section 1005.09A(1) to allow installation of additional signage onto his pre-existing non- conforming pylon sign, located in the front yard of 1935 Rice Street. 2.0 BACKGROUND 2.1 Mr. Duellman's family owns and operates the business at 1935 Rice Street. The property is zoned B-3 General Business District and the Comprehensive Plan indicates that the City should make an effort to clean up the businesses that front along Rice Street and provide for higher density housing in areas adjacent to the Rice Street corridor. 2.2 Tom's Mobil Service has existed at this location since 1957. The pylon sign has existed in its current location for the same 42 year period, however, the name changed from Shell to Mobil in 1977. The sign is a pre-existing non-conforming structure due to its encroachment into the front yard setback. 2.3 The existing pylon pole is located four (4) feet from the property line adjacent to Rice Street and the existing Mobil sign is located up to the property line adjacent Rice Street. 2.4 The proposed variance would enable Mr. Duellman to install additional gasoline pricing signage and maintain his sign in its exact location. 2.5 Staff does not have a survey to review exact locations for both the sign and property line. However, through field inspection it is estimated that the following circumstances occur on the Tom's Mobil Service parcel.
