<br />3.0 STAFF REVIEW & FINDINGS <br /> <br />3.1 Pylon signs are structures and Section 1005.01A(1) requires a 30 foot minimum front yard <br />setback for all structures. The applicant seeks a variance to allow the sign to remain in its <br />current location and for the installation of additional signage on the pylon sign pole that <br />does not encroach further into the front yard setback than that of the existing Mobil sign. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and demonstrate <br />that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 The structure, site, and sign were constructed 42 years ago prior to current regulations, thus <br />creating the pre-existing non-conformity. <br /> <br />3.4 The gas/service station, constructed to maximize the site, offers no alternative for relocating <br />the existing pylon. The current parking lot and drive lane area are located in the front of the <br />structure and cover 90+ percent of the site except for small grass areas along Rice Street and <br />McCarron Street. <br /> <br />3.5 The additional signage will not exceed the code requirement allowed in the B-3 General <br />Business District. Section 1009 .08E allows a maximum of 100 square feet for a pylon sign. <br />The existing (28.8 square feet) and proposed (20.64 square feet) signage equals 49.44 square <br />feet, which is 50 percent of the maximum allowed for a pylon sign in a B-3 General Business <br />District. The proposed sign addition will also be further (1.6 feet) away from the Rice Street <br />property line than the existing Mobil sign (zero). <br /> <br />3.6 The proposed variance, if granted, will not adversely affect the public health, safety, or <br />general welfare, provided standards/conditions are attached to insure that redevelopment <br />of the site is completed in accordance with the plans proposed by the applicant. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />Based on the findings outlined in Section 2.5 and Section 3.3 - 3.6 of this report, staff <br />recommends approval of the request for a variance to allow installation of 20.64 square <br />feet of additional signage on the pre-existing non-conforming pylon sign for Tom's Mobil <br />Service, located at 1935 Rice Street North. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />On July 14, 1999 the Roseville Planning Commission held a public hearing regarding the <br />variance request by Joseph Duellman. At this hearing, the Commission questions regarding <br />signs, future sight lines adjacent Rice Street, and whether limitations can be placed on <br />proposed sign so as to not affect a drivers clear view of Rice Street. Staff indicated that a <br />condition could be placed on the variance that would limit the location of the bottom of the <br />additional sign. The Roseville Planning Commission recommended (6-0) approval of the <br />request by Joseph Duellman for a variance to Section 1005.01A(1) based on the findings <br />PF3128 - RCA (072699).doc Page 2 of 2 <br />
