<br />,. <br /> <br />2. For the purposes of this Ordinance and the City of Red Wing Subdivision Ordinance; flag <br />lots shall have the following: <br /> <br />a. Limited frontage but not less than thirty (30) feet on a publicly dedicated right-of- <br />way; there shall be no other frontage for said lot. <br /> <br />b. An access drive, paved and constructed to a strength capable of supporting emergency <br />vehicles (fire trucks) to within fifty (50) feet of the structure. Said access-drive <br />shall be as straight and level as possible. <br /> <br />c. Said access drive shall conform to the requirements of Section 24-75 of this Ordinance <br />and shall not be on a parcel of land less than thirty (30) feet wide. This access <br />shall be maintained as landscaped yard similar to adjacent properties. <br /> <br />d. Said lot shall have a lot width at the building setback line of at least ninety (90) <br />feet. <br /> <br />e. Said lot shall meet all other area, size, and setback requirements of the zoning dis- <br />trict in which it is located. <br /> <br />f. Auxiliary pumps and utility support equipment necessary to make said lot buildable <br />shall be the responsibility of the owner and shall be approved by the City Engineer. <br /> <br />g. No building permit shall be issued if the above requirements cannot be met. <br /> <br />3. Assessments for street improvements and utilities for flag lots shall be determined on a <br />frontage plus lot area basis or as approved by the City Engineer and City Council. <br /> <br />4. All flag lots shall require a Conditional Use Permit and a public hearing or shall be <br />approved within a new plat. <br /> <br />5. Each flag lot as approyed by the City Council shall provide space for no more than one <br />(1) dwelling unit. <br /> <br />DIVISION 5 PERMITS, AMENDMENTS, APPEALS AND VARIANCES <br />Section 24-80 Conditional Use Permits <br /> <br />1. The City Council may grant a Conditional Use Permit in any district provided the proposed <br />use is designated in Section 24-35 of this Ordinance as a Conditional Use for the district, upon <br />finding that: <br /> <br />a. Certain conditions as detailed in the Zoning Ordinance exist; <br /> <br />b. The use or development conforms to the comprehensive land use plan of the community; <br /> <br />c. Is compatible with the existing neighborhood; <br /> <br />d. It is understood that, if approved, the Conditional Use Permit attached to the land and <br />not the owner or use of said land unless otherwise specified by the City Council. <br /> <br />2. T~~ling Administrator shall maintain a record of all applications for and all Conditional <br />Use Permits issued including information of the use, location, condition imposed by the City, time <br />limits, review dates, and such other information as may be appropriate. <br /> <br />3. Application. Application for Conditional Use Permit shall be filed with the Zoning Adminis- <br />trator. The application shall be accompanied by development plans for the proposed use showing such <br />information as may be reasonably required by the Administrator, including but not limited to those <br />things listed below. Such plans shall contain sufficient information as listed below for the City <br />to determine whether the proposed development will meet all applicable development standards and <br />whether sai d project is subject to a mandatory or an opti onal envi ronmental assessment statement as <br />stipulated in the Minnesota Environmental Quality Board regulations and in Section 24-90 of this Or- <br />dinance. <br /> <br />a. Site plan drawn to scale showing parcel and building dimensions. <br />b. Location of all buildings and their size, including square footage. <br />c. Curb cuts, driveways, access roads, parking spaces, off-street loading areas, and side- <br />walks. <br /> <br />-63- <br />
