REQUEST FOR COUNCIL ACTION

DATE: 06/29/99
ITEM NO: K-3

Agenda Section:
Ordinances

Item Description:

Abatement Process Ordinance (PF 3134)

1.0 Requested Action

Hold a first reading on an amendment to the City Code Section 407 related to the abatement process
for code violations.

2.0 Background

2.1 The current City Code does not adequately describe the procedure for correcting code
violations. For example, it is unclear regarding how to legally give notice to enter and
physically clean up an overgrown yard, snow, and ice. This proposed ordinance provides
clear direction. By adding a new section (407.08A) to the Code, an accelerated clean up
could occur.
2.2 The proposed amendment would direct the enforcement officer to provide written notice of
the correction that must be made within 5 days. If the vegetation, snow, or ice is not cleaned
up within 5 days, the City may clean it. up. The clean up cost can then be billed to the
property, payable with the taxes.

3.0 Suggested Council Action

3.1 Hold the first reading, asking for comment.

3.2 Add/Delete wording.

3.3 By motion, establish a second reading of the proposed ordinance for July 12, 1999.

""

/ /

PF3134 - RCA (06-29-99) - Page 1 of I
