(\ <br /> <br />. , , .\.' <br /> <br />enhance ..."aesthetics and fishery in the lake."4 <br /> <br />. <br /> <br />I have taken the opportunity to review the public documents concerning applications for <br />building permits and/or variances of other property owners for projects that are near the <br />shoreline of Lake Josephine. Based upon these documents, I believe it would be arbitrary <br />and capricious if the Council decides to deny me the opportunity to finish my deck. <br /> <br />In support of this conclusion, I would like you to review the following: <br /> <br />I. Property at 1199 Josephine Road5 <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />A. On August 25th, 1997 the City Council approved a variance request for this <br />property allowing a new addition to an existing structure, with this new <br />addition being set back only 22 ' from the ordinary high water level (OHWL) <br />of the lake. <br /> <br />B. Since this variance was granted, a screen porch has been added to the <br />property, and after careful investigation, I am unable to find any va~iance or <br />building permit that was required for this addition. <br /> <br />C. In addition to the screen porch, steps from the structure leading toward the <br />shore line have been added, with these steps being within 11' to 18' of the <br />water. <br /> <br />. <br /> <br />II. Property at 1225 Josephine Road:6 <br /> <br />A. This property has a building permit dated 6/23/97. <br /> <br />B. The dates in the permit may have been transposed, but it is clear that the <br />permit for a deck and landscaping was first denied as being too close to the <br />lake, but then approved "per OW', which! take to mean Dennis Walsh. <br />There is no indication that any type of variance was requested or required. <br />The deck for which the permit was issued in 1997 is within 18' of the <br />OHWL, and another deck was added this year which is also within 18' of the <br />OHWL. <br /> <br />It is not my desire to cause problems of any kind, either for the City, or other residents. <br />My purpose in pointing out these matters is to emphasize that we should be able to work <br /> <br />4 Design Report Kadrie Lakeshore Protection at Tab 1281 Josephine Road. <br /> <br />5 See attached Tab 1199 Josephine Road. <br /> <br />6 See attached Tab 1225 Josephine Road: <br /> <br />. <br /> <br />2 <br /> <br />-~ <br />
