COUNTY OF RAMSEY ) Charles Kadrie, being first duly sworn, on oath, deposes and states as follows: 1. I am the Plaintiff in the above captioned action, and make this affidavit in opposition to the Motion of Defendant for an Order holding me in constructive civil contempt in this matter. 2. The Order of Judge Flynn states that the above grade deck should be removed such that there be no building or appurtenance thereto closer than 26 feet 6 inches from the shoreline of Lake Josephine. 3. My property has previously been subject to severe shoreline erosion. I contacted the Hennepin Conservation District at the suggestion of the Department of Natural Resources. After reviewing the problem, which included the loss of at least six feet of shoreline I, Tom Peterson, District Manager of the Hennepin Conversation District, contacted the department of Natural Resources, urging their immediate approval of the permit request to stabilize my shoreline. The permit was granted and my property was the subject of a lakeshore protection design prepared by, and completed under the auspices of the Hennepin Conversation District. 4. As a part of completing this work, the Hennepin Conversation District brought in boulders and backfill, top soil and permanent plantings.
