Conditions Attached To Conditional <br />Use Permits: The City Council, upon <br />consideration of the criteria listed <br />above and the purposes of this Chap- <br />ter may attach such conditions to the <br />issuance of the conditional use per- <br />mits as it deems necessary. Such <br />conditions may include, but are not <br />limited to, the following: <br /> <br />1. Increased setbacks from the ordi- <br />nary high water level; <br /> <br />2. Limitations on the natural vegeta- <br />tion to be removed or the requirement <br />that additional vegetation be planted; <br />and <br /> <br />3. Special provisions for the location, <br />design, and use of structures, water- <br />craft launching and docking areas, <br />and vehicle parking areas. (Ord. 1156, <br />12-12-94) <br /> <br />1016.22: NONCONFORMITIES: All legal- <br />ly established nonconformities <br />as of the date of this Code amendment may <br />continue, but they shall be managed ac- <br />cording to applicable State statutes and <br />other regulations of the City for the subjects <br />of alterations and additions, repair after <br />damage, discontinuance of use and intensi- <br />fication of use. <br /> <br />The following standards apply to noncon- <br />forming lots and uses in the shoreland <br />management areas: <br /> <br />A. Construction On Nonconforming Lots <br />Of Record: <br /> <br />1. Lots of record in the office on the <br />County Recorder on the date of enact- <br />ment of the City shoreland controls <br />(March 27, 1974) that do not meet the <br /> <br />1016.22 <br /> <br />requirements of this Chapter may be <br />allowed as building sites without vari- <br />ances from lot size requirements pro- <br />vided; the use is permitted in the zon- <br />ing district; all sanitary requirements <br />of the City Code are complied with <br />insofar as practical; and the minimum <br />lot size and length of water frontage <br />shall be not less than seventy percent <br />(70%) of standard lot water frontage <br />requirements; the lot has been in <br />separate ownership from abutting <br />lands since the original adoption of <br />the City shore land controls (March 27, <br />1974). <br /> <br />2. A variance from setback require- <br />ments shall be obtained before any <br />use or building permit is issued for a <br />lot. In evaluating the variance, the <br />Board of Adjustment shall consider, in <br />addition to the requirements of Sec- <br />tion 1016.20, public utilities available <br />to the lot and shall deny the variance <br />if adequate facilities cannot be provid- <br />ed. <br /> <br />3. If,. in a group of two (2) or more <br />contiguous lots under one ownership <br />since the original adoption of the City <br />shore land controls (March 27, 1974), <br />any individual lot does not meet the <br />requirements of Section 1016.17, the <br />lot shall not be considered as a sepa- <br />rate parcel of land for the purposes of <br />development.
