<br />-- <br /> <br />.. ," <br /> <br />ORDINANCE NO. 1215 <br /> <br />AN ORDINANCE AMENDING SE IONS <br />602.06 (Boulevard Parking), 1012.07 (Non-m torized Pathways), <br />1011.02C (Minor Variance Procedure), an 1014.03 (Fees) <br />and CREATING SECTION 1013.05 (Setback rmit Procedures) <br />OF THE ROSEVILLE CITY CO E <br /> <br />THE CITY OF ROSEVILLE DOES ORDAIN: <br /> <br />Section 1. Purpose. The purpose of this Ordinanc is to remove the provisions for <br />minor variances and all references thereof throughout the Ci Code. This Ordinance will also <br />establish the procedures for a Setback Permit as Section 10 3.05, which will reduce approval <br />time. utilize a similar review process. and require no physical hardship finding as compared to <br />the minor variance procedure. <br /> <br />Section 2. Amendments. The Roseville City Code is ereby amended as follows: <br /> <br />Section 602.06. Parking on Boulevard Prohibited. No vehicle shall e parked on any boulevard adjacent <br />to a public street except for boulevard parking spaces listed on the inventory of boulevard parking <br />spaces regularly in use, dated June 30, 1984, prepared by the Code nforcement Officer, a copy of which <br />i5 incorporated herein by reference and which Ie: on file in the offi e of the City Manager. mav continue <br />to be used until one of the following occurs: <br /> <br />A:. Roadway improvements involving disturbance of or rem val of the boulevard parking area is <br />undertaken; or <br /> <br />B: Substantial improvements to the lot located adjacent to the b ulevard parking area is undertaken. <br />such expansion or construction of house, garage or driveway. <br /> <br />Section 1012.07. Non-motorized Pathways Required. <br /> <br />Section 1013.05. Procedure for Setback Permit. <br /> <br />A. Purpose. The purpose of the setback permit is to encour ge residents to upgrade and improve <br />their properties, while maintaining the overall character 0 the community. <br /> <br />B. Procedure For Setback Permit An owner of land may e an application for a setback permit <br />as defined in subsection 1 below by paying the fee set fo h in Section 1014.03 of this Title and <br />providing a completed application and supporting doc ents as set forth by the Community <br />Development Department The application shall then referred to the Development Review <br />Committee as set forth in subsection 2 of this Section. n the event that the Committee and <br />contiguous property owners unanimously recommend pproval of said setback permit, the <br />setback permit may be issued by the Community Dev lopment Director. In the event the <br />setback permit is not issued by the Community Develop ent Director, or if the applicant does <br />not find the conditions placed on such a permit per sub ection 1013.05(8)(10) acceptable, the <br /> <br />Ordinance 1215 - Page 1 of 4 <br />
