<br />and if they didn't attend the hearing, then there wasn't reason to be concerned as it was believed <br />to be acceptable to them. <br /> <br />However, after Keith Hauer-Lowe contacted the City it was then determined that the adjacent <br />neighbor could appeal the setback permit approval within 10 days from the issued date. Keith <br />Hauer-Lowe filed the appeal and delayed the process to be held before the City Council <br />members on September 27,1999. No place in the current Ordinance No. 1215 do we find <br />verbiage that indicates an appeal process. <br /> <br />We arrived at the county meeting at 7:15 p.m. as scheduled. Our appeal was addressed at 7:50 <br />p.m. The permit request was presented to the council members efficiently, however from there <br />on, we felt the City of Roseville misrepresented us as homeowners. We were not allowed to <br />speak at all at the council meeting to express our wants and needs and to ask further questions of <br />the adjacent homeowner as to why the appeal and could we come to agreement on this. The <br />council members were quick to pass a vote to rule that the setback permit hearing process needed <br />to start over. <br /> <br />We felt that the city council members were quick to take ownership on POSSIBLY failing to <br />follow proper procedures to our neighbor, however, were of no support to us. We feel that the <br />city's current "Purpose" for the procedural change to the setback permit to "Encourage residents <br />to upgrade and improve their properties, while maintaining the overall character of the <br />community", was not upheld by the Council Member whatsoever. <br /> <br />We are requesting that the City reimburse us for costs incurred for the inefficiencies in the <br />setback permit procedures. The total costs we incurred to date are: <br /> <br />$500 - Survey <br />$3408 - tree removal <br />$25 - city permit application <br />$500 - Builder fees <br />$150 - appraisal <br />$258 - banking fees <br />$4,391 total due <br /> <br />One last note, we no longer feel that living in our home with a neighbor that we will be upset <br />with for the next 30 years, as well as with a city that does not appear to be fair and equally <br />supportive, is in our best interest.
