DRINANE <br />PAMELA J CONVERSE <br /> <br />March 1, 1984 <br /> <br />Mr. Steve North <br />Assistant City Manager <br />Ci ty of Roseville <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br /> <br />Re: Phase Out of Billboards <br />Our File No. M4-2084 <br /> <br />Dear Mr. North: <br /> <br />The City adopted an ordinance requiring the phaseout of advertising signs <br />(billboards) by June 1, 1984, if they are in residential districts and by June 1, <br />1985, if they are in other districts (see Sections 14.036 and 14.037 of the City <br />Code). <br /> <br />In order to avoid the application of Minnesota Statutes Chapter 173, re~uiring <br />the payment of just compensation through condemnation if billboards are <br />required to be removed from along the interstate highway system, we excepted, <br />at Section 14.038, all advertising signs covered by that statute. <br /> <br />It appears that during the last year's legislative session, the sign industry made <br />an end run around the phaseout requirements of our ordinance and similar <br />ordinances of other cities, by lobbying for an amendment to Minn. Stat. Section <br />173.17 requiring that the just compensation through condemn~tion requirements <br />are applicable to all billboards, regardless of proximity to.:th.e inters'tate highway <br />system.
