<br />3.6 A small rear/side yard (north & east) exists on the north side ofthe lot and home. <br />Because this is the only flat area on the lot the three children use the location for a play <br />area. <br /> <br />3.7 The proposed step and porch addition, though encroaching to a point 8.6 feet and 10 <br />feet respectively from the Alta Vista Drive property line, would provide an architectural <br />design and living area that would not be afforded to the homeowners unless placed on <br />the north side of the home and within the play area. <br /> <br />3.8 Staff has determined that the limited flat area on the lot, the unique shape of the lot, <br />the lot's double frontage, and the date the home was constructed, are all pre-existing <br />hardships for this property that afford no alternative other than a variance. <br /> <br />3.9 The variance, if granted, will not adversely affect the public health, safety, or general <br />welfare of the citizens of Roseville. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the comments and finding outlined in Section 3, staff recommends approval <br />ofthe request for a variance from Section 1004.02D of the City Code to reduce the front <br />yard setback from 30 feet to 8.6 feet to accommodate the construction of a porch on <br />property located at 1810 Alta Vista Drive. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 On October 13, 1999 the Roseville Planning Commission held a public hearing <br />regarding the EI-Afandi/Kinnunen request for a front yard variance. At the hearing no <br />property owners or residents addressed the Commission regarding the variance <br />request. Staff presented the Commission with signatures from adjacent property <br />owners supporting the variance request. The Commission had only minor questions of <br />staff related to the request as well as a question of the applicant regarding the redesign <br />and relocated entry. <br /> <br />5.2 By motion the Planning Commission recommended (7-0) to approve the request by <br />Nadya El-Afandi for a variance from Section 1004.02D of the City Code to reduce the <br />front yard setback from 30 feet to 8.6 feet to accommodate the construction of a porch <br />on property located at 1810 Alta Vista Drive. <br /> <br />6.0 Suggested City Council Action <br /> <br />6.1 By resolution, approve (deny) request by Nadya EI-Afandi for a variance from Section <br />1004.02D of the City Code to reduce the front yard setback from 30 feet to 8.6 feet to <br />accommodate the construction of a porch on property located at 1810 Alta Vista Drive <br />subject to the findings and listed in Section 3.1 through 3.9 of the Report for Council <br />Action dated 10/25/99. <br /> <br />RCA (1 02599).docPage 3 of 4 <br />
