<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />Date: 05/14/01 <br />Item No: H-1 <br /> <br />Agenda Section: <br />HEARINGS <br /> <br />A Request by Sunrise Assisted Living to vacate a specific utility and <br />drainage easement and dedicate certain utility, drainage, and pathway <br />easements on property at 2555 Snelling Avenue (PF3159). <br /> <br />Manager A proved: <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Sunrise Assisted Living has requested the vacation of a utility easement located adjacent <br />to their facility currently under construction. Sunrise, has also proposed dedicating <br />utility and drainage, and pathway easements to cover storm sewer and pathway <br />construction. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The City Council previously approved a Planned Unit Development for the 77 unit <br />Sunrise Senior Housing Project at 2555 Snelling Avenue. This project is well under way, <br />but it did require a torrent title registration process in order to provide clear title. As part <br />ofthe historical search ofthe site, several utility easements were found on the site which <br />are no longer needed. This is a matter of correcting the paper records and has been <br />requested to facilitate the final financing of the project. <br /> <br />2.2 Section 1013.04 outlines the procedures for vacating streets, alleys, and easements. A <br />public hearing is required. In this case the City Council is holding the public hearing and <br />approving or denying the request. <br /> <br />3.0 REVIEW of REQUEST <br /> <br />3.1 The request to vacate is regarding a storm sewer easement that was never utilized and no <br />longer necessary. The easement lies on Parcel 2 of the property, directly west of the <br />Sunrise facility and 15 feet south of the Parcel 2 north property line (see attachment). <br /> <br />3.2 The request also proposes provision of four separate easements. These easements <br />(described below) are necessary for facilitation of storm water management or pathway <br />construction. They include: <br /> <br />A.
