REQUEST FOR CITY COUNCIL ACTION Date: 05/14/01 Item No: H-1 Agenda Section: HEARINGS A Request by Sunrise Assisted Living to vacate a specific utility and drainage easement and dedicate certain utility, drainage, and pathway easements on property at 2555 Snelling Avenue (PF3159). Manager A proved: 1.0 REQUESTED ACTION 1.1 Sunrise Assisted Living has requested the vacation of a utility easement located adjacent to their facility currently under construction. Sunrise, has also proposed dedicating utility and drainage, and pathway easements to cover storm sewer and pathway construction. 2.0 BACKGROUND 2.1 The City Council previously approved a Planned Unit Development for the 77 unit Sunrise Senior Housing Project at 2555 Snelling Avenue. This project is well under way, but it did require a torrent title registration process in order to provide clear title. As part ofthe historical search ofthe site, several utility easements were found on the site which are no longer needed. This is a matter of correcting the paper records and has been requested to facilitate the final financing of the project. 2.2 Section 1013.04 outlines the procedures for vacating streets, alleys, and easements. A public hearing is required. In this case the City Council is holding the public hearing and approving or denying the request. 3.0 REVIEW of REQUEST 3.1 The request to vacate is regarding a storm sewer easement that was never utilized and no longer necessary. The easement lies on Parcel 2 of the property, directly west of the Sunrise facility and 15 feet south of the Parcel 2 north property line (see attachment). 3.2 The request also proposes provision of four separate easements. These easements (described below) are necessary for facilitation of storm water management or pathway construction. They include: A.
