A pathway easement, running along a majority ofthe eastern property line adjacent the access road, necessary because of the required path location. 3.0 POLICY & FISCAL IMPLICATIONS 3.1 There are no policy or fiscal implications. 4.0 STAFF COMMENTS & RECOMMEND A TION 4.1 This is a record keeping issue that has no impact on the land use or the utility system. 4.2 The Engineering Department has reviewed, provided comments, and approved the necessary vacation and dedications. All documents must be recorded prior to the issuance of a certificate of occupancy for the Sunrise facility. 4.3 Based on the findings in Section 4.1 and 4.2, staff recommends approval of the utility easement vacation and dedication of necessary utility, drainage, and pathway easements of the property at 2555 Snelling Avenue. 5.0 PLANNING COMMISSION ACTION 5.1 On April 14, 2001 the Planning Commission recommended that the easement be vacated; the easements necessary for the provision of storm water management and pathway facilitation be accepted; and that the City Council hold the public hearing to efficiently expedite the request. 6.0 SUGGESTED COUNCIL ACTION 6.1 By motion approve (approve with modifications or deny) the request by Sunrise Assisted Living to vacate a specific utility and drainage easement (attached); and 6.2 By motion accept the provision of new utility, drainage, and pathway easements.
