<br />concept development plan), and March 13, 2000 (City Council hearing on final <br />development plan), to consider various aspects of the Planned Unit Development, <br />including the rezoning of the subject property from Limited Business (B-1) and Retail <br />Business (B-2) to Residential Planned Unit Development (R-PUD). The City agrees to <br />rezone the subject property to R-PUD subject to the Developer's strict compliance with <br />the approved plans, and the terms and conditions of this Agreement. The approved use is <br />Assisted Senior Living. The City's Development Review Committee, under the direction <br />of the Community Development Director, may approve minor variations from the <br />approved final development plans. Substantial departures from the approved final <br />development plans will require an amendment to the Residential Planned Unit <br />Development in accordance with Section 1015 of the Roseville Zoning Ordinance. <br />Where not superseded by the specific requirements of the R-PUD in this agreement, or <br />the approved exhibits to this agreement, the standards of the underlying R-3 (High <br />Density Residential) zoning district shall apply, as stated in Chapter 1004 of the Roseville <br />City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the Developer to commence development activity, in accordance with the final <br />assisted living/senior development plans, within one year following the final Council <br />approval ofthis Planned Unit Development (March 13,2000), will necessitate the <br />approval of an extension of the development schedule by the City Council prior to <br />issuance on any construction permits. If an extension is not applied for, the Council may <br />instruct the Planning Commission to initiate rezoning to the original zoning district. For <br />purposes of this provision, development activity shall be defined as obtaining a grading <br />or building permit and beginning construction on the site. <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The Developer represents to the City that the proposed development will comply with all <br />City, County, Regional, Metropolitan, State and Federal laws and regulations, including <br />but not limited to the Roseville Zoning regulations, Rice Creek Watershed regulations <br />and all other applicable environmental regulations. The Developer agrees to comply with <br />all such laws and regulations. . <br /> <br />8.0 Site Development Requirements and Subdivision Standards <br /> <br />To ensure that the proposed development meets the City's requirements and standards for <br />site development, the following provisions shall apply: <br /> <br />Page 3 of 10 <br />
