<br />3.0 Planned Unit Development <br /> <br />The City hereby grants approval of the final development plan for Sunrise Senior <br />Assisted Living Planned Unit Development, subject to the Developer's compliance with <br />the terms and conditions of this Agreement. The City agrees to approve applications for <br />building permits, provided that said plans are consistent with the exhibits that were <br />approved at the concept and final stage of the Planned Unit Development process, and all <br />of the standards and conditions of this Agreement have been satisfied. <br /> <br />For two (2) years ITom the date of this Agreement, no amendments to the City's <br />Comprehensive Plan or official controls shall apply to affect the use, development <br />density or site layout unless required by state or federal law or agreed to in writing by the <br />City and the Developer. Thereafter, notwithstanding anything in this Agreement to the <br />contrary, the City may require compliance with any amendments to the City's <br />Comprehensive Plan and official controls enacted after the date of this Contract, so long <br />as said amendments do not prohibit developers or its successors and assigns use of the <br />property as an assisted senior living facility. <br /> <br />4.0 Approval by the City <br /> <br />In approving the final development plan for the PUD, the City hereby incorporates the <br />following exhibits. The Developer shall develop the subject property as described or <br />shown in these exhibits. If the exhibits vary ITom the written terms of this Agreement, <br />the written terms shall control. The exhibits marked as approved by the City Council on <br />March 13, 2000, or as amended thereafter, shall include: <br /> <br />A. Site Development Plan <br />B. Grading Plan <br />C. Drainage Plan <br />D. Utility Servicing Plan <br />E. Landscape Plan <br />F. Lighting Plan <br />G. Building Elevations <br />H. Building Floor Plans <br />I. Project Narrative and Application <br />J. Signage Plan <br />K. Proof of Parking Documentation <br />L. City Street Tree Master Plan <br />M. Erosion Control PlanlPermit <br /> <br />5.0 Rezoning <br /> <br />The City conducted hearings and meetings on January 10,2000 (Planning Commission <br />hearing on concept development plan), January 24, 2000 (City Council meeting on <br /> <br />Page 2 of 10 <br />
