Landscaping shall be installed and maintained in accordance <br />with the landscape plan (Exhibit E). Areas of land not occupied by buildings, <br />driveways and/or parking/loading areas, or ponding shall be landscaped with a <br />sod turf or other vegetative material approved by the Community <br />Development Director. All landscaped areas shall be irrigated to protect the <br />turf, trees and/or landscaping materials. Trees and large shrubs shall not be <br />planted over existing utility lines. Developer shall make all reasonable efforts <br />to preserve (or move and preserve) existing deciduous and coniferous trees <br />over 6" in diameter. Landscaping in rights-of-way will require permits ITom <br />the appropriate units of government. <br /> <br />9.10 Landscape Bond. Prior to the commencement of site construction activities <br />by the Developer, and at the time of issuance ofthe building permit, the <br />Developer shall post with the City a 24-month landscape bond, a letter of <br />credit, or other security acceptable to the City in an amount equal to 150% of <br />the cost of all site landscaping, street tree planting as per City Street Tree <br />Master Plan, and site grading and turf restoration. The Community <br />Development Director, following the completion of all site construction plans, <br />shall determine the specific amount of this letter of credit, bond or other <br />security. <br /> <br />9.11 Project Signage. The project will be allowed one project identification sign in <br />accordance with site and sign plans and detail (Exhibit J), and in accordance <br />with the City Code. The project sign shall be designed to complement the <br />architecture and appearance of the building. <br /> <br />9.12 Recreational Vehicles and other Vehicles over One Ton. Motorized <br />recreational vehicles and vehicles over one ton carrying capacity, and/or <br />trailers, shall not be parked or stored within the development, except for <br />resident multi-passenger transportation vans or busses and maintenance <br />equipment. <br /> <br />9.13 Ponding and Surface Water Management. The Developer shall adhere to City <br />and Rice Creek Watershed Surface Water Management provisions and <br />regulations, National Water Run-Off Program standards, and any applicable <br />best practices standards to construct and provide surface water management. <br /> <br />9.14 Driveway Access to Adjoining Properties. The Developer may permit, <br />without amendment to this Agreement, abutting the property owners to the <br />west or north of the project driveway access easements across the Developer's <br />property to Oakcrest A venue or Snelling A venue Frontage Road, provided <br />necessary driveway permits are obtained ITom the City. <br /> <br />Page 7 of 10 <br />
