<br />approve applications for building permits, provided that said plans are <br />consistent with the exhibits which were approved at the concept and final stage <br />of the Planned Unit Development process, and all of the standards and <br />conditions of this Agreement have been satisfied. <br /> <br />For two (2) years from the date of this Agreement, no amendments to the City's <br />Comprehensive Plan or official controls shall apply to affect the use, <br />development density or site layout unless required by state or federal law or <br />agreed to in writing by the City and the Developer. Thereafter, notwithstanding <br />anything in this Agreement to the contrary, the City may require compliance <br />with any amendments to the City's Comprehensive Plan and official controls <br />enacted after the date of this Contract. <br /> <br />4.0 Approval by the City <br /> <br />In approving the final development plan for the PUD, the City hereby <br />incorporates the following exhibits. The Developer shall develop the subject <br />property as described or shown in these exhibits. If the exhibits vary from the <br />written terms of this Agreement, the written terms shall control. The exhibits <br />marked as approved by the City Council on March 13, 2000, or as amended <br />thereafter, shall include: <br /> <br />A. Site Development Plan <br />B. Grading Plan <br />C. Drainage Plan <br />D. Utility Servicing Plan <br />E. Landscape Plan <br />F. Lighting Plan <br />G. Building Elevations <br />H. Building Floor Plans <br />I. Project Narrative and Application <br />J. Signage Plan <br />K. Proof of Parking Documentation <br />L. City Street Tree Master Plan <br />M. Erosion Control Plan/Permit <br /> <br /> <br />5.0 Rezoning <br /> <br />The City conducted hearings and meetings on January 10, 2000 (Planning <br />Commission hearing on concept development plan), January 24, 2000 (City <br />Council meeting on concept development plan), and March 13,2000 (City <br />Council hearing on final development plan), to consider various aspects of the <br /> <br />Page 2 of 10 <br />
