<br />Planned Unit Development, including the rezoning of the subject property from <br />Limited Business (B-1) and Retail Business (B-2) to Residential Planned Unit <br />Development (R-PUD). The City agrees to rezone the subject property to R-PUD <br />subject to the Developer's strict compliance with the approved plans, and the <br />terms and conditions of this Agreement. The approved use is Assisted Senior <br />Housing. Minor variations from the approved final development plans may be <br />approved by the City's Development Review Committee, under the direction of <br />the Community Development Director. Substantial departures from the <br />approved final development plans will require an amendment to the Residential <br />Planned Unit Development in accordance with Section 1015 of the Roseville <br />Zoning Ordinance. Where not superseded by more restrictive requirements of <br />the R-PUD, the standards of the underlying R-3 (High Density Residential) <br />zoning district shall apply, as stated in Chapter 1004 of the Roseville City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the Developer to commence development activity, in accordance with <br />the final senior housing development plans, within one year following the final <br />Council approval of this Planned Unit Development (March 13, 2000), will <br />necessitate the approval of an extension of the development schedule by the City <br />Council prior to issuance on any construction permits. If an extension is not <br />applied for, the Council may instruct the Planning Commission to initiate <br />rezoning to the original zoning district. For purposes of this provision, <br />development activity shall be defined as obtaining a grading or building permit <br />and beginning construction on the site. <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The Developer represents to the City that the proposed development will comply <br />with all City, County, Regional, Metropolitan, State and Federal laws and <br />regulations, including but not limited to the Roseville Zoning regulations, Rice <br />Creek Watershed regulations and all other applicable environmental regulations. <br />The Developer agrees to comply with all such laws and regulations. <br /> <br />8.0 Site Development Requirements and Subdivision Standards <br /> <br />To ensure that the proposed development meets the City's requirements and <br />standards for site development, the following provisions shall apply: <br /> <br />Page 3 of 10 <br />
