October 28,1999

Mr~ Eric Peterson
2977 Woodbridge Street
Roseville, MN 55113

RE: Requested Setback Permit for Allowance Driveway Encroachment.

Dear Mr. Peterson:

After further consideration following our scheduled meeting on October 14, 1999 and
based on new evidence, clarification and the circumstances regarding your request, the
Development Review Committee has recommended approval of your request for a three
(3) foot encroachment into the required five (5) foot side yard setback.

It is clear that the mistake in the placement of the concrete curb and gutter entrance
constructed by the City earlier in the year would require you to construct an odd
driveway with a short but cumbersome angle to match into the City project.

Given this unfortunate situation, the DRC recommended that you be allowed to taper
your driveway to provide a smooth transition from the five (5) foot setback area to the
two (2) foot setback of the constructed access point.

Since the action of the DRC the 10 day appeal time line has passed and the City has not
received any opposition from neighboring property owners. Hence, your request has
been approved and you are able to proceed with your development plans upon proper
submittal of a permit application and appropriate plans.

Should you have any questions or comments regarding the DRC's action, please feel free
to contact Doug Strong, Engineering Supervisor, at 651.490.2225 or me at 561.490.2236.

,Q:\Planning Files\3167 ]eterson, Eric\DRC Action Letter 2.doc

2660 Civic Center Drive + Roseville + Minnesota + 55113
651-490-2200 + TDD 651-490-2207
