The criteria to be used in reviewing the Conditional Use Permit for these uses <br />are that all conditions in the Zoning Ordinance (including suggested provisions <br />here or as modified by the City) must be met and the City Council must find that <br />the activities, impacts, and characteristics of the use in question between the hours <br />of 10:00 pm and 7:00 am that are seen, felt, or heard by adjacent residents will not <br />resu1t in a loss of reasonable peace and quietude appropriate for that residential <br />neighborhood. <br /> <br />ZONING ISSUES <br />Based on our experience in providing planning and zoning advice to many communities, from <br />the experience of other communities gleaned from our research and interviews, from designing <br />numerous commercial developments for private clients, and from hearing input from residential <br />neighbors in Roseville and in many communities throughout the State, we believe the major <br />concerns of residents adjacent to commercial areas can be reasonably addressed by the following <br />zoning standards. <br /> <br />Definition of Use <br /> <br />Issue: <br />Solution: <br />Suggestion: <br /> <br />Loading Areas <br /> <br />Issue: <br />Solution: <br /> <br />Suggestion: <br /> <br />What are "twenty-four hour uses"? <br />Clarify in the ordinance the definition and applicability of such a designation. <br />· Include in the Zoning Code a definition for twenty..four uses as any commercial <br />use t..'1at is open for business, delivery, or other activity during a..."y hour between <br />10:00 pm and 7:00 am. <br />· Clarify in the Zoning Code that a change in hours of operation of any existing <br />use to include the hours noted above constitutes an expansion and intensification <br />of the use and makes it non-confonning, requiring compliance with the Code <br />provisions regarding non-conforming uses. <br /> <br />Location of loading docks and service areas, hours of operation <br />Screen loading areas completely from residential us(~s; for twenty-four hour uses, <br />locate away from residential side of site. <br />· Any commercial loading dock within 300' of a residential district must be <br />completely screened by an opaque wall, landscaped berm, or fence from an <br />adjacent residential area, from a point 14' above the ground at the loading area to a <br />point 5' above the first floor (main level) of adjacent residences. <br />· Any commercial loading dock within 300' of a residential district which is to be <br />used for any reason by vehic1es or equipment between the hours of 10:00 pm and <br />7:00 am must be within a completely enclosed and roofed structure.
