The trees to be planted shall be a minimum <br />of three feet in height. <br />All plantings/trees shown on the October 25, 1994 plan in the westerly buffer area <br />(from County Road E to the most northerly home) shall be forever replaced by the <br />Developer if the plant/tree dies, unless the City determines the particular planting <br />does not need to be replaced because adequate buffer remains. The size of the <br />replacement tree shall be determined by the City but the size shall be the same as the <br />original planting. <br /> <br />Article 1 3 <br />There are several infrastructure improvements that need to be made with this development. <br />This article will outline those needed improvements, who will be responsible for constructing <br />the improvement, and the timing of the development in correlation with the development of <br />the Vadnais Square project. <br /> <br />A. <br /> <br />General Municipal Water Pressure <br />There is a recommendation by the City Fire Marshal to improve the water flow in the <br />development area to 5,000 gallons per minute. The City Council will determine if the <br />Fire Marshal's request is reasonable and warranted and, if so, determine how this <br />water flow requirement can be accomplished. The City Council will establish its <br />findings and decision on or before March 8, 1995. <br />Watermain Connection to Ce'hte~ille Road <br />It is desired to loop the internal water main from this development northwesterly to <br />Centerville Road. If the Developer cannot work out the necessary <br />easements/agreement with the landowner to the west, the Developer shall stub off a <br />watermain connection, as specified by the City Engineer, to their west property line. <br />The Developer waives the right to appeal an assessment for the cost of extending the <br />watermain across the railroad right-of-way and for the cost of oversizing a watermain <br />from 8" to up to 12" from the railroad right-of-way to Centerville Road in the future. <br />The Developer agrees to make assessment payments for this watermain extension in a <br />period not to exceed three years from the date assessments are adopted by the City <br />Council and certified to Ramsey County for collection. <br />Right/left Turn lanes and Signal Modification at Main Entrance Drive <br />The Developer shall install, at the Developer's expense, left and right turn lanes on <br />County Road E and make necessary signaf modifications, induding Opticon <br />accessories as per plans and specifications approved by the City Engineer and Ramsey <br />County and Minnesota Department of Transportation. These improvements must be <br />completed prior to an occupancy permit being issued. <br />Arcade Street/County Road E ImDrovements <br />A signal light needs to be installed at the south Arcade Street/County Road E <br />intersection prior to any occupancy permit being issued. The installation of the signal <br />can be done by either the City or the Developer, however, plans and specifications <br />shall be approved by the City Council and Ramsey County. The signal system shall <br />include an Opticon system for emergency vehicles. Twenty-five percent (25%) of the <br />cost of the system shall be paid for from monies collected from Wal-Mart"for t~is <br /> <br />B. <br /> <br />-5- <br />
