REQUEST FOR CITY COUNCIL ACTION DATE: 12/15/99 ITEM NO: Department Approval: Manager Approved: Agenda Section: ORDINANCES& RESOLUTIONS Item Description: City of Roseville request for amendment to Section 1002 (Rules & Definitions), 1006, (Shopping Center District), 1008, (Planned Unit Developments), and 1013 (Conditional Use Permits) of the Roseville City Code. (PF3177) 1.0 Background 1.1 At the Monday, December 13, 1999 City Council meeting the Council received additional written and oral comments on proposed amendments to the City Code relating to nighttime business uses and activities in Shopping Center Districts. Following the staff and consultant reports and receipt of resident and business testimony, the Council discussed the proposed amendments. Subsequently, the Council voted to table further deliberation and possible action on the proposed ordinance until Wednesday, December 15, 1999. 1.2 In order to facilitate discussion and a decision regarding this proposal, staff has attached a "clean" copy of the ordinance as recommended by the Planning Commission, which was included in the Monday meeting agenda packet as Attachment C, and is recommending that the Council consider additions and deletions to the draft addressing the concerns raised at the Monday meeting. These suggested revisions are shown by strike and underline type fonts, and include additional punctuation and grammatical modifications as well as substantive provisions. 2.0 Proposed Ordinance-Areas of Concern/Remaining Issues 2.1 Review process. The ordinance proposes two processes for approval. The first process would allow the Development Review Committee and the Community Development Director to administratively approve "24 hour service" site plans that meet existing and proposed City Code requirements. The staff would also review minor amendments, defined as up to a 10% change in the building cube, which as indicated in the record is consistent with the City's previous practices. The second process would require a conditional use permit for any new structure or expansion of an existing structure by more than 10% of its current gross floor area. The conditional use permit process also addresses major issues that could potentially impact residential areas directly adjacent to the Shopping Center Districts. Councilmember Wiski and others that significant off-site impacts could be expected irrespective of major additions to the cubic area of the structure or changes in hours of operation to include 24-hour uses raised concerns.
