<br />2.3 Phase III summarizes DSU's conclusions and recommendations regarding twenty-four <br />hour uses in the Shopping Center District adjacent to residential areas. These <br />recommendations are based on research, analysis, input from neighbors and business <br />leaders, and experience with similar planning and zoning issues of other communities. <br /> <br />3.0 Proposed Ordinance <br /> <br />3.1 On November 22,1999, the Roseville City Council held first reading of a proposed <br />ordinance amending Sections 1002, 1006, 1008, and 1013 ofthe Roseville City Code <br />(Attachment A). The proposed (draft) amendments were developed by the City <br />Attorney and followed the recommendations in the DSU report. <br /> <br />3.2 The ordinance proposes two processes for approval. The first process would allow the <br />Development Review Committee and the Community Development Director to <br />administratively approve "24 hour service" site plans that meet with existing and <br />proposed City Code requirements. The staff could also continue to review minor <br />amendments, up to a 10% change in the building cube as is the current practice. <br /> <br />3.3 The second process would require a conditional use permit for any new structure or <br />expansion of an existing structure by more than 10% of its current gross floor area. <br />The conditional use permit process also addresses major issues that could potentially <br />impact residential areas directly adjacent to the Shopping Center Districts. <br /> <br />4.0 Planning Commission Action <br /> <br />4.1 On December 8, 1999, the Roseville Planning Commission held a public hearing to <br />consider the proposed amendments to Sections 1002, 1006, 1008, and 1013 of the <br />Roseville Zoning Ordinance. Following the public hearing and consideration of <br />testimony and written comments, the Planning Commission amended the proposed <br />draft, directed staff to make additional modifications consistent with the Planning <br />Commission's direction, and recommended approval of the amendments to Section <br />1002,1006,1008, and 1013 of the Roseville Zoning Ordinance. The vote on the motion <br />was 7 to O. (Attachment D - Minutes) <br /> <br />4.2 The proposed draft ordinance, as amended and directed by the Planning Commission, <br />is provided (Attachment B). To ease review, staffis also providing the City Council <br />with another version of the proposed draft ordinance as recommended by the Planning <br />Commission that omits all strikeouts, bolding, italics, and underlining (Attachment C). <br />(If no modifications are made by the City Council, Attachment "C" would be the final <br />ordinance that is published.) <br /> <br />RCA (121399)Page 2 of3 <br />
