2.3 Phase III summarizes DSU's conclusions and recommendations regarding twenty-four hour uses in the Shopping Center District adjacent to residential areas. These recommendations are based on research, analysis, input from neighbors and business leaders, and experience with similar planning and zoning issues of other communities. 3.0 Proposed Ordinance 3.1 On November 22,1999, the Roseville City Council held first reading of a proposed ordinance amending Sections 1002, 1006, 1008, and 1013 ofthe Roseville City Code (Attachment A). The proposed (draft) amendments were developed by the City Attorney and followed the recommendations in the DSU report. 3.2 The ordinance proposes two processes for approval. The first process would allow the Development Review Committee and the Community Development Director to administratively approve "24 hour service" site plans that meet with existing and proposed City Code requirements. The staff could also continue to review minor amendments, up to a 10% change in the building cube as is the current practice. 3.3 The second process would require a conditional use permit for any new structure or expansion of an existing structure by more than 10% of its current gross floor area. The conditional use permit process also addresses major issues that could potentially impact residential areas directly adjacent to the Shopping Center Districts. 4.0 Planning Commission Action 4.1 On December 8, 1999, the Roseville Planning Commission held a public hearing to consider the proposed amendments to Sections 1002, 1006, 1008, and 1013 of the Roseville Zoning Ordinance. Following the public hearing and consideration of testimony and written comments, the Planning Commission amended the proposed draft, directed staff to make additional modifications consistent with the Planning Commission's direction, and recommended approval of the amendments to Section 1002,1006,1008, and 1013 of the Roseville Zoning Ordinance. The vote on the motion was 7 to O. (Attachment D - Minutes) 4.2 The proposed draft ordinance, as amended and directed by the Planning Commission, is provided (Attachment B). To ease review, staffis also providing the City Council with another version of the proposed draft ordinance as recommended by the Planning Commission that omits all strikeouts, bolding, italics, and underlining (Attachment C).
